Indeed, this determination goes to the heart of OSHA\u0027s special competence\u0027 (at 15-16); \u0027the Court holds that the issue of Smithfield\u0027s compliance with OSHA\u0027s guidelines and regulations falls squarely within OSHA/USDA\u0027s jurisdiction\u0027 (at 17); \u0027the Court cannot ignore the USDA\u0027s and OSHA\u0027s authority over compliance with the Joint Guidance\u0027 (at 24).
