Operative words
If I choose not to implement the CDC guidance, what restrictions must I comply with? You must continue to adhere to all provisions and restrictions in the DOH Interim Guidance on Food Services, e.g., all patrons must wear face coverings other than when seated... tables must be spaced 6 feet apart... Capacity is limited to the lesser of 100% of certificate of occupancy or the number of individuals as can be properly spaced.... You must have a system in place that distinguishes between patrons and employees who are fully vaccinated and those who are unvaccinated.

Notes
Late Q2 2021: capacity by distancing, masks for the unvaccinated, and vaccination-status systems remained conditions of on-premises service until June 24, 2021.
Retrieval noteThe guidance itself is not an order or rule. Cite the Executive Order (and any SLA emergency rule) as the instrument and the guidance as evidence of its application).
