Social Assistance and Community Services

The industry is the set of employers that deliver publicly funded care and support outside institutions: adult day care and adult day health centers, senior centers and congregate-meal sites, day-habilitation and vocational programs and group homes for people…

In plain terms: if you run an adult day center, a senior center, a day-habilitation or residential program for people with developmental disabilities, a sheltered workshop, a family-services agency, a food bank, a meal program or a homeless shelter, the orders of 2020 and 2021 reached the thing your business is: a room in which people who need care or support gather at a scheduled time under a public payer's rules. From March 13, 2020 Governors closed adult day centers and senior centers by name in a dozen jurisdictions and by category everywhere else. Federal directives barred visitors and group activities from every group home and intermediate care facility. Congress rewrote the congregate-meal program, HUD rewrote the shelter rules, and every State's Medicaid waiver was amended so that day programs were billed from participants' homes. Reopening came at 30 percent of fire occupancy, under health-department conditions, or not at all: New Jersey's adult day health services facilities stayed closed by order until June 15, 2021. In the third quarter of 2021 a federal occupational standard, a federal visitation and vaccine-offering condition and the vaccination or testing orders of seventeen jurisdictions governed this industry's settings and workers.

Those orders reached all eleven functions of a business in this industry. The quarter the letters most often dispute is the third quarter of 2021, and the record answers it: on every day of that quarter, in every State, a federal occupational standard, a federal visitation condition and a federal payment amendment were in force on this industry.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Social Assistance and Community Services, from the industry's own record.

  3. The change it compelled: the operative words.The operative words of 1915(c) Home and Community-Based Services Waiver Instructions and Technical Guidance, Appendix K: Emergency Preparedness and Response (Ex. SEC-24-008): “This appendix was developed as a standalone appendix to be utilized by the state during emergency situations. It should be used by the state to advise CMS of expected changes to its waiver operations or to request amendment to its approved waiver.... This appendix may be completed retroactively, as…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as eleven functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
