Physician Practices and Outpatient Care

The industry is the ambulatory layer of American medicine: NAICS 6211 offices of physicians (establishments of M.D.s and D.O.s in independent general or specialized practice, in their own offices or in the facilities of others), 6213 offices of other health…

In plain terms: if you run a physician practice, an outpatient clinic, a behavioral health practice or an allied health practice, this page shows what governmental orders did to businesses like yours from March 2020 through September 30, 2021, and answers the sentence in the IRS's letters. Between March 15 and April 10, 2020, at least thirty-two States ordered elective and non-urgent procedures postponed, and every other State and the District of Columbia confined your patients under stay-at-home or closure orders. From late April 2020 the prohibitions became conditions: PPE, testing, distancing, screening and appointment-only visits. Seven States re-tightened procedures in the winter of 2020-21. In 2021 the general orders ended on dates from March 10 (Texas) to July 1 and later, but every State kept its health care rules, and from June 21, 2021 a federal workplace standard written for health care alone governed every clinic that did not screen every visitor at the door. Between July and September 2021, fifteen States, the District of Columbia and Puerto Rico ordered your staff vaccinated or tested.

The orders reached every function of the business: waiting room, procedures, laboratory, telehealth, front desk, billing, supplies, hiring, workforce, patients and referral sources, outreach. A "partial suspension," as the court defined it in Tri-State, a 2026 federal decision, is a temporary delay, interruption or termination of a portion of the business because of those orders; no percentage is required. This page establishes that suspension for each of the six quarters from instruments you can open in the Library. The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it: the orders in force on every day of that quarter are listed below with issuer, date, operative words and enforcement.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Physician Practices and Outpatient Care, from the industry's own record.

  5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
