Logistics, Warehousing and Wholesale

The industry that moved every other industry's goods was never closed as such, and that is the point of its record: every order that closed, capped or reconfigured a shipper, a receiver, a store, a restaurant, a plant, a port, a border crossing, a…

In plain terms: if you run a trucking company, a freight brokerage, a warehouse, a distributor or a wholesale house, the orders of 2020 and 2021 reached your business from every side. They closed the stores, restaurants, plants and job sites you delivered to. They fixed how your own dock could run: half occupancy in New York, eleven mandatory rules for every "warehousing business" in New Jersey, written prevention programs with civil penalties in California, Virginia, Michigan, Oregon and Washington. They put quarantine lines and checkpoints across your drivers' routes, closed the truck-stop dining rooms and turnpike plazas those drivers depended on, and held both land borders to "essential travel" for twenty months. They shut the motor-vehicle offices that test and license your drivers and limited the collection sites that certify them. From February 1, 2021 a federal order put a mask on every person at every port, port of entry and rail yard and in every cab with more than one occupant. In the summer of 2021 seven States, the District of Columbia and the freight hubs from Los Angeles to Boston reinstated face-covering requirements on every indoor workplace, New York activated exposure-prevention plans in every private workplace, and OSHA named general warehousing a target for programmed inspection.

Partial suspension, element by element

The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
