Agriculture and Food Processing

The conclusion. Agriculture and food processing were reached by orders in every one of the six claimable quarters, and the proof begins with the President's own words. Executive Order 13917 of April 28, 2020 (85 Fed. Reg. 26313) found that 'recent actions in…

In plain terms: if you ran a farm, a ranch, a packing house, a food-processing plant or a farm labor crew between March 2020 and September 2021, the government told you, under penalty, how many workers could sleep in a bunkhouse, how far apart they had to stand in the row and on the line, who could ride in the crew bus and what they had to wear, whether your seasonal workers could get a visa interview or cross the border at all, and whether the restaurants, schools and cafeterias that bought about half of what you produced were allowed to open their doors. In April 2020 the large meat plants closed outright and the President put every meat and poultry processor under the Defense Production Act. Washington, Oregon and California wrote rules for the labor camp and the field; Michigan tested every camp resident; North Carolina and Kentucky wrote rules for the plant floor; every consulate stopped routine visa interviews on March 20, 2020; both land borders were limited to essential travel until November 8, 2021.

The orders reached all ten functions of the business, from the field and the line to the workforce, the inputs, the transport and the customers. This page sets those orders out by layer, quarter and function, with instrument numbers, dates and exhibit links, and answers from the public record the fourteen sentences the Internal Revenue Service (the "Service") uses in its letters. Four terms recur: the "Suspension Clause" (CARES Act § 2301(c)(2)(A)(ii)(I) and I.R.C. § 3134(c)(2)(A)(ii)(I)), the "Notice" (Notice 2021-20), the "United States" (the Government as a litigant) and the "Library" (this site's Orders Library; "Ex. SEC-20-001" is an exhibit). The quarter the Service's letters most often dispute is the third quarter of 2021, and the record answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Agriculture and Food Processing, from the industry's own record.

  3. The change it compelled: the operative words.The operative words of Suspension of Routine Visa Services (announcement of Mar. 18, effective Mar. 20, 2020) (Ex. SEC-20-012): “the Department of State is temporarily suspending routine visa services at all U.S. Embassies and Consulates. Embassies and consulates will cancel all routine immigrant and nonimmigrant visa appointments as of March 20, 2020.   4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v.
