In plain terms: if you run a brokerage, a property-management company, a title or escrow agency or an appraisal firm, government orders governed what you could do from March 2020 through September 30, 2021. In the spring of 2020, seven States and the health officers of the largest counties in California, Texas and Hawaii ordered in-person real estate work to stop or confined it to what was legally necessary. Every other State capped gatherings at ten or fewer, which made every open house unlawful, and confined your buyers and tenants to their homes. County recorders closed their counters. More than twenty States rewrote the notary's physical-presence rule by emergency instrument. Thirty-four States and the District of Columbia stayed evictions, and from September 4, 2020 a federal order with criminal penalties told every landlord in the country not to evict.

When the States let showings resume, between April 20 and June 22, 2020, they did so on conditions written into orders: by appointment, with two, three or four people in the property, no open houses, face coverings on everyone in the room. Those conditions were released only between May 19 and July 1, 2021. The eviction orders ran longer: the federal order to July 31 and again to August 26, 2021, the FHA and FHFA moratoria to September 30, 2021. In the third quarter of 2021 indoor face-covering orders returned in a dozen States and thirty metropolitan areas, and every showing and closing in them ran under those orders.

This page sets out those orders by layer, quarter and function, with the issuer, date and exhibit for each, and answers the fourteen sentences the Service's letters use. The quarter the Service's letters most often dispute is the third quarter of 2021, and the record on this page answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Real Estate, from the industry's own record.

  1. The order: issuer, instrument, date, exhibit.The Library holds 82 instruments from this industry's own regulators and sector authorities and 23 organizer notices. The earliest is Governor Gavin Newsom, Executive Order N-28-20 (Mar. 16, 2020) (Ex. SEC-14-046). The fifty-State regime table below names the State orders that reached its premises, State by State, each with its exhibit; the federal layer and the standing duties sit behind them on every day of the six quarters.
  2. The function of the business it reached.The orders named the functions of the business in terms.   3. The change it compelled: the operative words.The operative words of Executive Order N-28-20 (Ex. SEC-14-046): “1) The time limitation set forth in Penal Code section 396, subdivision (f), concerning protections against residential eviction, is hereby waived. Those protections shall be in effect through May 31, 2020. 2) Any provision of state law that would preempt or otherwise restrict a local government's…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force. The six quarters sets out what was in force in each, and the third quarter of 2021 is listed instrument by instrument below.
  5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes

The analysis describes the business as eleven functions, each with a two-letter code that every page of this set uses without variation. An order “reached” a function when its operative words told the business what that part of it could do, when, where, for how many and on what conditions.
