In plain terms: if you own or run a dental or orthodontic practice, government orders governed what you could do in your operatory from March 2020 through September 30, 2021. In the spring of 2020, at least thirty States and the District of Columbia ordered you to stop everything but emergency care: no hygiene visits, no crowns, no orthodontic adjustments, no cosmetic work. Every other State confined your patients to their homes while your dental board directed you to see emergencies only. When the States let you reopen, between April 22 and June 8, 2020, they let you reopen on conditions written into orders: a telephone screening before every appointment, a temperature check at the door, an N95 respirator for every procedure that throws an aerosol, a fallow interval between patients, an emptied waiting room, a written plan and a protective-equipment supply you were forbidden to draw from public stockpiles.

Those conditions ran through the second quarter of 2021: Texas's board rule to June 18, Iowa's proclamation to June 26, Oregon's and Washington's to June 30. A federal rule allocated your respirators away from you from April 7, 2020 to June 30, 2021. Ten days before the third quarter of 2021 began, a federal workplace standard took effect for every health-care setting, a federal enforcement program named offices of dentists by NAICS code, and four States, four metros and a territory conditioned your staff's employment on vaccination or testing, several naming "dental offices" in terms.

The quarter the Service's letters most often dispute is the third quarter of 2021, and the record on this page answers it.

Partial suspension, element by element

Every analysis on this site asks the same five questions in the same order. Here they are asked of Dental Practices, from the industry's own record.

  3. The change it compelled: the operative words.The operative words of CHFS Directive on non-emergent, non-urgent health care (Mar. 23, 2020) (Ex. SEC-03-050): “1. ALL non-emergent, non-urgent in-person medical, surgical, dental, and any other healthcare practice or procedure must have immediately ceased effective close of business on March 18, 2020.... All healthcare providers are instructed to follow these recommendations when considering what procedures…” Each record page quotes the operative words in full, with the enforcement provision beside them.
  4. The quarter: in force on which days.Every instrument carries the quarters it was in force.   5. The statute's answer.A partial suspension is a temporary delay, interruption or termination of a portion of the business's operations; the order need only be the but-for cause of it; and nothing in the Suspension Clause asks whether the business was essential, stayed open, could telework or served customers who were themselves under orders (Tri-State Memorial Hospital v. Function codes
