Operative words

The state Department of Health ordered Brewski's Pub & Grub to close Saturday as an imminent threat to public health.... "We expect compliance with our public health guidelines," Gov. Asa Hutchinson said at a news conference Monday. "If you're not complying with those, if they are not willing to enforce it, then they cannot stay in operation."

Penalty

Closure order pending a Department of Health hearing

What it required

Shows the Department closing a permitted bar for operating above 66 percent capacity, without distanced seating and without ensuring patron face coverings 'as is required' by the directive, the closure to hold until a hearing, and the Governor stating that compliance with the public health directives was the condition of remaining in operation.

Retrieval note

The report describes its findings ('not limiting guest capacity to 66 percent or arranging seats to ensure social distancing, as is required'; 'not ensuring that customers wore protective masks'). Contemporaneous reports (Arkansas Democrat-Gazette, July 6, 2020; KARK) describe the same order; KARK reported it as a cease-and-desist order issued after an Alcoholic Beverage Control inspection on July 3, 2020 found violations of the Directive on Resuming Bar and Club Operations.
