Operative words

8567. (a) The Governor may make, amend, and rescind orders and regulations necessary to carry out the provisions of this chapter. The orders and regulations shall have the force and effect of law.... (b) Orders and regulations... issued during a state of war emergency or state of emergency shall be in writing and shall take effect immediately upon their issuance.

Penalty

Gov. Code section 8665 (DUT-CA-007): misdemeanor, fine up to $1,000 and/or imprisonment up to six months, for refusing or wilfully neglecting to obey any lawful order or regulation issued under the chapter.

What it required

Made every executive order issued under the Act (EO N-25-20, N-33-20, N-60-20, N-84-20, N-07-21, N-08-21, N-09-21 and the rest of the CA series) law binding on every person in California from the moment of issuance, so that the stay-at-home directive, the reopening framework and the Cal/OSHA readoption order operated with the force of statute and not as advice. Retrieval note

Official text as displayed Sept. 28, 2026. Section 8567 was construed in Newsom v. Superior Court (Gallagher) (DUT-CA-018), which quotes it and holds that the Act authorizes quasi-legislative orders. Section 8571 (suspension of regulatory statutes) is the authority recited in EO N-09-21 (CA-067) for giving the readopted ETS immediate effect.
