Operative words
(2) A small business is immune from civil liability for any act or omission that results in exposure, loss, damage, injury, or death arising out of COVID-19 if the small business attempts in good faith to comply with applicable guidelines unless the exposure, loss, damage, injury, or death was caused by gross negligence or a willful and wanton act or omission of the small business.
Penalty
What it required
Nothing (not enacted). The special-session bill would have protected only a small business that 'attempts in good faith to comply with applicable guidelines'; its failure on the day of introduction left Colorado businesses under the ordinary negligence and premises-liability standards. Character as recorded: not_enacted (legislative history; no legal effect).
Retrieval noteCapitalization of new statutory text normalized; words unchanged. Bill summary: 'The bill establishes immunity from civil liability for small businesses for any act or omission that results in exposure, loss, damage, injury, or death arising out of COVID-19 if the small business attempts in good faith to comply with applicable public health guidelines.' History from leg.colorado.gov: introduced in the Senate and assigned to Finance Nov. 30, 2020; postponed indefinitely the same day; status 'Lost'.
