Operative words

(1) Except in cases where a different punishment is prescribed in this code, every offense declared to be a misdemeanor, is punishable by imprisonment in a county jail not exceeding six (6) months, or by a fine not exceeding one thousand dollars ($1,000), or by both.

What it required

Fixed the punishment for the misdemeanors declared by Idaho Code §§ 56-1003(7)(c) and 56-1008 (which prescribe none of their own): up to six months in the county jail, a fine up to $1,000, or both.

Retrieval note

Section 39-419(2) prescribes its own lesser penalty ($300 or six months) for violations of chapter 4 of title 39.
