Operative words
Violation of the terms of this Order or the DPH Guidance may result in a criminal penalty pursuant to Section 8 of Chapter 639 of the Acts of 1950 or a civil fine of up to $300 per violation, in the manner provided for non-criminal disposition of violations of municipal by-law, ordinance, rule, or regulation pursuant to G.L. c. 40, s. 21D

Non-essential brick-and-mortar premises 'shall close... to workers, customers, and the public'; providers of COVID-19 Essential Services continued under the DPH Guidance the Order made binding (including a requirement of limited-access hours for vulnerable populations at grocery retailers); remote operation by closed businesses was 'encouraged' (verb recorded as a recommendation); gatherings over ten prohibited; on-premises consumption at restaurants and bars prohibited; enforced by DPH and 'any board of health or authorized agent under G.L. c. 111, s. 30, with State or municipal police.'
