Operative words
Isolation and quarantine must be by the least restrictive means necessary to prevent the spread of a communicable or potentially communicable disease to others and may include, but are not limited to, confinement to private homes or other private or public premises.
Penalty
Enforcement under § 144.4195 subd. 1(d) (read, not saved): 'Any peace officer... may apprehend, hold, transport, quarantine, or isolate a person subject to the order'; group orders may be posted at the premises (subd. 1(c)); Minn. Stat. § 12.39 subd. 1 (read in DUT-MN-006) allows the commissioner to order a person who refuses testing or treatment 'to be placed in isolation or quarantine according to parameters set forth in sections 144.419 and 144.4195'.
What it required
It authorizes the Commissioner of Health to isolate infected persons and quarantine exposed persons and groups, restricting 'activities or travel of an otherwise healthy person who likely has been exposed', with confinement to private or public premises; 'communicable disease' expressly includes 'severe acute respiratory syndromes', 'influenza that can cause a pandemic' and 'a new or novel or previously controlled or eradicated infectious agent'.
Retrieval noteSubd. 1 cl. (2): 'communicable disease' means a disease 'for which isolation or quarantine is an effective control strategy, including... (ii) severe acute respiratory syndromes; (iii) influenza that can cause a pandemic;... (v) a new or novel or previously controlled or eradicated infectious agent or biological toxin'. Subd. 1 cl. (4): 'quarantine' means 'restriction, during a period of communicability, of activities or travel of an otherwise healthy person who likely has been exposed to a communicable disease'. § 144.4195 (due process: ex parte order from the Ramsey County or local district court on probable cause; 'one order shall suffice to isolate or quarantine a group of persons'; peace-officer enforcement) was read in the Revisor's 2020 text and is cited from it.
