Operative words

.. Occupational Safety and Health Codes and rules are amended by incorporating and adopting by reference, and thereby making a part thereof, Title 29 of the Code of Federal Regulations as listed in subparts 1a to 7.... QQ. Federal Register, Volume 86, No. 116, pages 32376-32628, dated June 21, 2021; "Occupational Exposure to COVID-19; Emergency Temporary Standard."

Penalty

§ 182.666 (DUT-MN-007): violation of an adopted standard is a violation of § 182.653 subd. 3; up to $70,000 per willful or repeated violation, $7,000 per serious violation.

What it required

It made the federal general-industry standards (29 C.F.R. part 1910, including respiratory protection, PPE, sanitation and bloodborne pathogens) and the recordkeeping rules of part 1904 binding Minnesota law under § 182.653 subd. 3, and, by items QQ and TT, adopted the OSHA COVID-19 Healthcare Emergency Temporary Standard of June 21, 2021 (29 C.F.R. § 1910.502 et seq.) for Minnesota health-care employers, later narrowed to the recordkeeping provisions when the federal standard was withdrawn in part.

The Revisor serves only the current version of the rule as a PDF; the 2020-2021 version's list of adopted Federal Register amendments ended earlier, but subpart 1's adoption sentence and the adoption of 29 C.F.R. part 1910 are the standing mechanism. Item QQ adopts 86 Fed. Reg. 32376 (June 21, 2021), the COVID-19 Healthcare ETS, and item RR adopts 86 Fed. Reg. 61402 (Nov. 5, 2021), the vaccination-and-testing ETS; a later item TT re-adopts the June 21, 2021 standard 'with the exception of 1910.502 (c) to (p) and (s), 1910.504, 1910.505, and 1910.509', tracking OSHA's December 2021 withdrawal of the non-recordkeeping provisions. the Federal Register date of June 21, 2021 is the date recorded here.
