Operative words

All rules and regulations authorized and made by the department of health and senior services in accordance with this chapter shall supersede as to those matters to which this chapter relates, all local ordinances, rules and regulations and shall be observed throughout the state and enforced by all local and state health authorities.

Penalty

RSMo 192.320 (class A misdemeanor) for violation of the provisions of sections 192.020 to 192.490 (Ex. DUT-MO-004)

What it required

Every Department rule (and every order made under 192.020 and 19 CSR 20-20.040) must be observed throughout the State and enforced by all local and State health authorities, and local authorities may add further ordinances, rules and regulations not inconsistent with the Department's; the three statewide orders quote this section as their enforcement clause.

MO-004, MO-006 and MO-007 each provide: 'Pursuant to section 192.290, RSMo, this Order shall be observed throughout the state and enforced by all local and state health authorities; provided however, nothing herein shall limit the right of local authorities to make such further ordinances, rules, regulations, and orders not inconsistent with this Order,' followed by: 'Local public health authorities are hereby directed to carry out and enforce the provisions of this Order by any legal means.'.
