Operative words
If You Have COVID-19: Isolate for at least 10 days, even if you have been vaccinated.... Do not go to work until your isolation period ends.... Go to your workplace if you are considered essential by your employer, and only if you have no symptoms. Wear a mask at all times while at work, and have your temperature and symptoms monitored by your employer.
Penalty
Through the State Health Officer's isolation orders: § 41-23-2 felony (Ex. DUT-MS-008); § 41-3-15(12) detainment (Ex. DUT-MS-001)
What it required
Persons who test positive stay home at least ten days and do not go to work; unvaccinated exposed persons quarantine and, if retained as essential, work only asymptomatic, masked and under employer temperature and symptom monitoring. The directive is written in the imperative; its compulsory force for infected persons rests on the State Health Officer's isolation orders under § 41-23-5 with the § 41-23-2 felony (Exs. DUT-MS-006, DUT-MS-008), and its employer-monitoring instruction is the MSDH content that the shield's condition and the general duty clause made the employer's standard of care.
