Penalty

None in the page itself; the standards it lists are enforced through G.S. 95-138 and 95-139 (Ex. DUT-NC-005)

What it required

The page states which mandatory standards NCDOL enforces against COVID-19 exposure (the Part 1910 PPE, respiratory-protection, sanitation, signage, exposure-records, bloodborne-pathogen and hazard-communication standards, the construction and maritime counterparts, 13 NCAC 07F.0207 and the general duty clause of G.S. 95-129(1)) and recommends engineering, administrative and work-practice controls ('Maintain a physical distance of at least 6 feet from other people', 'Wear a cloth face covering, especially when physical distancing cannot be maintained', 'Clean and disinfect work areas frequently'); the controls are recommendations, the standards listed are law under G.S. 95-129(2), and 'Where respirator use is required, the employer must implement an effective respiratory protection program'.

Retrieval note

Recorded as guidance: its work-practice list is advisory in terms and is not pleaded as a duty; its statement of applicable standards identifies the mandatory instruments (Exs. DUT-NC-005, DUT-NC-009). the NCDOL memos of 2022 (Exs. DUT-NC-015, DUT-NC-016) confirm the Division's COVID-19 enforcement program from 2020 onward.
