Operative words

An individual adjudged guilty of a Class B misdemeanor shall be punished by: (1) a fine not to exceed $2,000; (2) confinement in jail for a term not to exceed 180 days; or (3) both... a Class C misdemeanor shall be punished by a fine not to exceed $500.... a felony of the third degree shall be punished by imprisonment... for any term of not more than 10 years or less than 2 years.

What it required

The punishment ranges that give content to the offenses in this folder: the Class B misdemeanor of Health and Safety Code § 81.087 (Ex. DUT-TX-006), the Class C misdemeanor of § 437.016 (Ex. DUT-TX-018) and the third-degree felony of § 81.085(h) (Ex. DUT-TX-005), the last also carrying a fine to $10,000 under § 12.34(b).
