Operative words

Each employer shall: (a) furnish to each of its employees employment and a place of employment that are free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees; and (b) comply with occupational safety and health standards promulgated under this chapter.

Penalty

Civil penalties up to $7,000 per cited violation, $250 to $7,000 per serious violation, $5,000 to $70,000 per willful violation, up to $7,000 per day for an uncorrected violation (Utah Code section 34A-6-307, Ex. DUT-UT-012)

What it required

Every Utah employer had to furnish employment and a place of employment free from recognized hazards likely to cause death or serious physical harm and to comply with every UOSH standard, including the federal standards adopted by reference under section 34A-6-202 and Utah Admin. Code R614-1-5 and the COVID-19 emergency rule R614-1-5.F (Ex. DUT-UT-018); every employee 'shall comply' with the standards, rules and orders applicable to the employee's own conduct (subsection (2)).
