Operative words

At the request of the department or a local health department, an individual who meets the criteria established by the department under Subsection (2)(b) shall submit to testing for COVID-19. (b) The department: (i) shall establish protocols to identify and test individuals who are present at a care facility and are at high risk for contracting COVID-19

Utah Code section 26-23-6 (Ex. DUT-UT-003) for violation of the chapter or a lawful order

What it required

Individuals present at care facilities (the facilities described in section 26-6-6(2) to (6)) who met the Department's criteria 'shall submit to testing for COVID-19' at the Department's or a local health department's request; the Department had to establish testing protocols and could 'establish who is responsible for the costs of the testing'; a care facility could discharge a resident whose refusal endangered others under the Department's criteria.
