Operative words

(a) The Commissioner shall adopt rules and standards necessary to implement the purposes and duties set forth in this subchapter insofar as they relate to safety and to enforcement of the VOSHA Code. (b) The Commissioner... shall adopt rules and standards necessary to implement the purposes of the VOSHA Code and duties imposed by the Code, insofar as they relate to health.

What it required

The Commissioner of Labor to adopt the safety and health standards of the VOSHA Code, which VOSHA does by incorporating the federal standards of 29 C.F.R. parts 1910 and 1926 by reference (29 C.F.R. 1910.6 incorporation as a VOSHA rule) and by adopting federal emergency temporary standards; it is the vehicle by which the federal COVID-19 Healthcare ETS became a Vermont rule in July 2021 (Ex. DUT-VT-017), binding on every employer under sec. 223(a).

Subsections (c)-(e) require standards to prescribe labels, protective equipment and monitoring, permit medical examinations, and, for toxic materials, set 'the standard that most adequately ensures, to the extent feasible... that no employee will suffer material impairment of health'. The VOSHA Rules and Regulations page (labor.vermont.gov) lists under 'VOSHA Adopted Rules' the 'COVID-19 Healthcare ETS', 'Subpart U: COVID-19 Emergency Temporary Standard' and '1910.6 Incorporation by reference'.
