Operative words
Any person who shall knowingly have or use about his premises... any clothing, bedding or other substance used by, or in taking care of, any person afflicted with... infectious or contagious disease, or infected thereby, or shall do any other act with intent to, or necessarily tending to the spread of such disease, into any neighborhood or locality, shall be deemed guilty of a misdemeanor
Penalty
35-4-109: fine of not more than $500, or imprisonment in the county jail not exceeding six months, or both, and an order that infected property be destroyed; 35-4-110: civil damages to all persons infected, maintainable by a decedent's representative
What it required
Every person must refrain from any act 'necessarily tending to the spread' of an infectious or contagious disease about his premises or into any neighborhood, on pain of a misdemeanor (35-4-109), and is 'liable in a civil action in damages to any and all persons, who may, from that cause, become infected', including expenses, loss of time and burial expenses (35-4-110).
Retrieval noteA standing duty on the operator of premises that predates the pandemic and does not depend on any order: the operator who admits an infected person to a crowded room, or runs an operation 'necessarily tending to the spread', answers in the criminal and civil courts.
