Operative words
1. Effective at 12:01 p.m. on Wednesday, April 8, 2020, [all public or private mass gatherings that bring together or are likely to bring together more than 10 people in a confined or enclosed space at the same time are prohibited]... c. With regard to churches or other religious services or activities, [gatherings] of more than ten congregants or parishioners in the same building or confined or enclosed space [are prohibited];... [those] conducting or performing a religious service may exceed ten as long as those [individuals maintain distancing]; d. With regard to funerals or memorial services, [the same ten-person limit applies].
Enforcement
K.S.A. 48-939. The Legislative Coordinating Council purported to revoke EO 20-18 on Apr. 8, 2020; the Kansas Supreme Court held on Apr. 11, 2020 (Kelly v. Legislative Coordinating Council) that the LCC lacked that authority (verified_secondary). A federal TRO of Apr. 18, 2020 barred enforcement against two churches (First Baptist Church v. Kelly, D. Kan.) (verified_secondary).
