Operative words
Order No. 53 recital: 'the Department of Public Health has today issued a Stay at Home Advisory that urges all persons in the Commonwealth to remain at home between the hours of 10:00 PM and 5:00 AM in order to slow the spread of the virus, preserve hospital capacity, and save lives.' Order No. 13 recital: 'the Department of Public Health is urging all residents of the Commonwealth to limit activities outside of the home and to practice social distancing at all times.'

Massachusetts styled its stay-home instruction an 'advisory' while the binding closure of all non-essential premises and the 10-person cap were imposed by Order No. 13; the Safer at Home Advisory of May 18, 2020 is recited in Orders No. 38 and 44 as the basis for outdoor face coverings.
