Operative words

Section 1. In order to maintain public safety and health while facilitating restaurants' ability to utilize outdoor seating, I hereby direct the Department of Transportation to establish and administer a program to expand seating options for restaurants, bars and other establishments in certain outdoor areas, including the sidewalk, curbside and street space directly in front of such restaurants, bars or establishments... (the 'Open Restaurants Program').

Enforcement

Program conditions administered by DOT subject to DOHMH, NYSDOH and SLA guidance; suspends Admin. Code ss. 10-125, 17-306(c), 19-124, Title 20 ch. 2 subch. 6, 20-465(q)(1), Building Code ss. 3101.1, 3111, 3202.4.1 and RCNY fire-safety provisions to the extent necessary

Notes

Evidences that indoor dining remained closed in the City through Phases 2-4 (June 22 to Sept. 30, 2020) and again Dec. 14, 2020 to Feb. 12, 2021; the City's own recital is that the program exists 'to help establishments rebound in these difficult economic times'.
