Operative words

Section 1. I hereby order that a covered entity shall not permit a patron, full- or part-time employee, intern, volunteer, or contractor to enter a covered premises without displaying proof of vaccination and identification bearing the same identifying information as the proof of vaccination.

Enforcement

s. 9 (from Sept. 13, 2021): fine, penalty and forfeiture of not less than $1,000 for a first violation, not less than $2,000 for a second within twelve months, not less than $5,000 for each further violation within twelve months; enforceable by DOHMH and other agencies under Health Code ss. 3.07 and 3.11 with a standard penalty of $1,000 or default penalty of $2,000

Notes

Exempts pre-K to grade 12 schools, houses of worship, child care programs, senior centers and community centers (EEO 228 s. 4(f)(2)). Recites that 56 percent of City residents were fully vaccinated on Aug. 16, 2021. The first proof-of-vaccination mandate for private indoor commerce in the United States.
