Operative words

These rules take effect upon filing with the secretary of state and shall remain in effect for 6 months.... Rule 5. Basic infection prevention measures for all employers.... (8) The employer shall create a policy prohibiting in-person work for employees to the extent that their work activities can feasibly be completed remotely.

Enforcement

MIOSHA citations and penalties under MCL 408.1035-.1036; MIOSHA issued COVID-19 emergency-rule citations (e.g., Midway Rentals and Sales; Prefix Corporation; Eastbrook Homes, per the LEO document index)

Notes

Replaced the Governor's workplace-safeguard orders after October 2, 2020 with the same daily screening, distancing, face-covering and sector rules plus the remote-work prohibition; the MDHHS gathering orders of December 2020 and January 2021 expressly exempt 'Workplace gatherings that occur consistent with the Emergency Rules issued by MIOSHA on October 14, 2020.'

Retrieval note

Existence and date confirmed from the MDHHS orders' own references (Ex. MI-061, MI-063) and the LEO document index; Retrieved and read in-session (late retrieval). Rule 5(8) confirmed verbatim in the retrieved text: 'The employer shall create a policy prohibiting in-person work for employees to the extent that their work activities can feasibly be completed remotely.' Extension (Apr. 13, 2021), amendment (May 24, 2021) and rescission (June 22, 2021) dates remain from prior research.
