The Kansas City metropolitan area was governed from March 2020 through the third quarter of 2021 by a coordinated set of local orders issued by the four 'Core 4' jurisdictions (Kansas City, Missouri; Jackson County, Missouri; Johnson County, Kansas; the Unified Government of Wyandotte County/Kansas City, Kansas) together with the Clay County Public Health Center, the Platte County Health Department and the Independence Health Department, in a two-State region where neither State imposed a statewide mask order in Missouri or a durable statewide business regime after mid-2020, so the local instruments were the operative limits on commerce, travel and group meetings for nearly the whole period. 2020 Q2 (with the March 13-31 run-up): Jackson County proclaimed a state of emergency on March 12, 2020, capped gatherings at 250 on March 13, at 50 on March 15 (Executive Order 20-05) and, on March 17 (Executive Order 20-06), defined a 'Group Event' as any gathering of 10 or more at any restaurant, tavern, professional, social, cultural, entertainment or other special event and prohibited all Group Events and all School Operations absent an approved mitigation plan; Johnson County's Board of Health Order 001-20 (March 19) closed all restaurants, bars, taverns, clubs and movie theatres to the public and prohibited gatherings of more than ten; the 16th Circuit suspended jury impanelment from March 16 (Administrative Order 2020-053) and barred whole classes of persons from the courthouse (2020-059). On March 21 the Core 4 announced a metro-wide stay-at-home regime effective 12:01 a.m. March 24, 2020; Jackson County's Stay at Home Order (March 22; effective March 24 to April 24, 11:59 p.m.) directed every individual outside Kansas City to stay home except for essential activities, ordered all businesses to cease non-essential operations at physical locations, prohibited all non-essential gatherings 'of any number of individuals' and confined child care to stable groups of ten; Kansas City's Second Amended Order 20-01, the Johnson and Wyandotte Local Health Officer orders and the Clay and Platte orders imposed the same regime on the same day (Johnson and Wyandotte were folded into Kansas EO 20-16 from March 30). Jackson County's Amended Stay at Home Order (April 16) 'clarifies, strengthens, and extends' the order; the 16th Circuit extended its stay-at-home operations order through May 15 (2020-073). Reopening began May 11, 2020: Jackson County's Phase One order (May 12, effective May 11 to May 31) kept mass gatherings of ten or more prohibited, required every business open to the public to complete and post a Social Distancing Protocol, and kept gyms closed until May 18; Kansas City's Fourth Amended Order (May 6) imposed the '10/10/10' rule; Johnson and Wyandotte reopened under phased Local Health Officer orders on May 11 (Wyandotte keeping dine-in closed and hotels at 25 percent); Clay County's orders ran the same course. Phase Two (June 1) kept retail at 25 or 10 percent occupancy in Clay County and 50 percent in Jackson County; the 16th Circuit kept jury trials cancelled through July 31 (2020-079, 2020-096). 2020 Q3: on June 29 to July 3 every Core 4 jurisdiction imposed a mask order (Kansas City's Ninth Amended Order June 29; Wyandotte effective June 30; Jackson County's Phase 2.5 Order of July 1 requiring all persons over five 'present at any business or public accommodation' to wear a face covering and restaurants and bars to 50 percent occupancy; Johnson County affirming Kansas EO 20-52 on July 2, effective July 3; Clay County's mask order effective July 19 and extended August 21 'until further notice'; Platte County's masks from July 16). Those orders ran through the quarter (Jackson County August 21 and October 2 Phase 2.5 orders; Kansas City's Tenth Amended Order). 2020 Q4: on November 13 the six regional health directors issued a joint advisory and every jurisdiction re-tightened within a week: Johnson County Board of Public Health Order 002-20 (effective November 16; gatherings capped at 50 or 50 percent; midnight closing and four-hour closure for bars and restaurants; venues over 2,000 barred from events; fairs, festivals and parades prohibited; enforcement by Resolution 108-20 with fines up to $500); Jackson County's Amended Order (November 18, effective November 20; 50 percent occupancy; 10:00 p.m. closing; parties of ten; gatherings over ten require a Gathering Protocol approved seven business days in advance); Kansas City's Eleventh Amended Order (November 20) and the Clay (November 23) and Platte (November 23) orders to the same effect. 2021 Q1: the regime was re-imposed and extended in January (Jackson County January 13; Kansas City Twelfth Amended Order January 13; Clay January 14; Platte January 16; Johnson County extended Order 002-20 on January 28 to March 31), relaxed in late February (Johnson County removed curfews February 25; Jackson County February 26; Kansas City Thirteenth Amended Order February 19; Clay February 21; Platte February 22), and, in Johnson County, replaced on March 25 by the Local Health Officer's countywide mask-and-distancing order (effective March 26 through April 30, 2021) after Kansas SB 40 revoked the Governor's orders as of March 31. 2021 Q2: masks remained mandatory in every jurisdiction through April (Jackson County April 8 and April 30 orders lifted capacity limits but kept masks and required businesses to 'deny entry to and refuse to serve' the unmasked); Johnson County let its order expire at midnight April 30 (Resolution 032-21); Kansas City and Jackson County lifted masks on May 14, 2021; Wyandotte, Clay and Platte followed in May. The Kansas state of disaster emergency expired June 15, 2021; Missouri's EO 21-07 emergency ran to August 31, 2021; Kansas City's Sixth Amended Proclamation of a state of emergency ran to August 31, 2021. 2021 Q3: the Delta wave brought the orders back. Kansas City's Order 21-01 (signed July 30; effective 12:01 a.m. August 2; expiring August 28) required masks 'at indoor places of public accommodations'; Committee Substitute for Ordinance No. 210694 (passed August 19) rescinded and replaced it through September 23, 2021 at 3:00 p.m., with a $25 to $500 fine or up to six months' imprisonment and suspension of the certificate of occupancy for violators; Ordinance 210853 (passed September 23) carried the requirement to October 7, 2021 at 11:59 p.m., and Committee Substitute for Ordinance No. 210903 (October 7) to November 4, 2021, when Ordinance 210902 narrowed it to schools and school buses. Jackson County's Health Order of August 6, 2021 (effective 12:01 a.m. August 9; expiring September 7 under RSMo 67.265) required every person five and older to wear a face covering in places of public accommodation; the County Legislature extended it by Resolution 20749 (August 30) to October 7, Resolution 20781 (October 4) to November 7 and Resolution 20806 (November 1) to November 22, and ended it by Resolution 20814 on November 12, 2021. Johnson County's Board of Health Order 001-21 (August 5; effective August 9, 2021 through May 31, 2022) required masks in every public and private school building serving grade six or below and on every school bus. The Unified Government adopted an indoor mask order on August 5, 2021 (8-2), effective through September 16, extended on September 9 to November 18, 2021, with its local emergency extended to December 16, 2021. The Missouri Attorney General sued Kansas City (August 3, 2021) and Jackson County (August 19, 2021) in the Jackson County Circuit Court; neither order was enjoined during the quarter, and both were in force on September 30, 2021. In Kansas, SB 40 exposed every county and school order to expedited judicial review; a Johnson County District Court judgment (July 2021) held SB 40's review provisions unconstitutional and the Kansas Supreme Court stayed that judgment on August 24, 2021, restoring the review procedure while the Johnson County school order remained in force.

What remained in force

The Kansas City Sixth Amended Proclamation of a state of emergency (to August 31, 2021); Missouri EO 21-07 (Mar. 26, 2021; terminated Aug. 27, 2021 by EO 21-09, which continued the state of emergency to Dec. 31, 2021); the Johnson County state of local disaster emergency (declared March 19, 2020, renewed May 28, 2020, 'remains in place' as recited August 5, 2021); the federal CDC conveyance mask order on all RideKC and school transportation; and, from August 2, 2021 (Kansas City), August 5-9, 2021 (Wyandotte; Johnson County schools) and August 9, 2021 (Jackson County), the Delta-wave mask orders, which were in force on September 30, 2021 in Kansas City, Jackson County, Wyandotte County and every Johnson County school building through grade six.

The State and the local orders

Missouri: no statewide preemption during 2020; Missouri never issued a statewide mask order and after June 15, 2020 imposed no statewide business, gathering or travel restriction, so the Kansas City, Jackson, Clay, Platte and Independence orders were the operative limits. HB 271 (L. 2021), enacting RSMo 67.265 effective June 15, 2021 (Ex. MET-KC-078), limited any local order that 'directly or indirectly closes, partially closes, or places restrictions on the opening of or access to any one or more business organizations, churches, schools, or other places of public or private gathering' to thirty calendar days in a 180-day period unless extended by a simple-majority vote of the governing body (and to twenty-one days by two-thirds vote outside a chapter 44 emergency), required a supporting report before issuance, and gave governing bodies the power to terminate any order by simple majority. Every Q3 2021 Kansas City and Jackson County instrument was issued under and complied with that statute (the Kansas City Health Department's reports of July 30, August 18, September 15 and October 5, 2021 (Exs. MET-KC-004, -005, -007, -009) are the 67.265 reports; the Jackson County resolutions of August 30, October 4 and November 1, 2021 (Exs. MET-KC-046 to -048) are the 67.265 extensions). The Attorney General's suits against Kansas City (filed August 3, 2021) and Jackson County (filed August 19, 2021) in the Jackson County Circuit Court did not produce an injunction during Q3 2021 (Ex. MET-KC-081, secondary). The Cole County Circuit Court's judgment in Robinson v. Missouri Department of Health and Senior Services (November 22, 2021) post-dates the period and is not relied on. Kansas: 2020 Special Session HB 2016 (signed June 8, 2020) (Ex. MET-KC-079) let a board of county commissioners adopt orders 'less stringent than' a statewide executive order, made Governor Kelly's mask order EO 20-52 (July 2, 2020) effective in a county only if the board did not opt out, and amended K.S.A. 65-202 to subject local health officer orders to board review; Johnson County affirmed EO 20-52 on July 2, 2020 (4-2-1) and the Unified Government kept its own mask order, so the mask regime applied in both counties without interruption from July 3, 2020. SB 40 (2021) (signed March 24, 2021) (Ex. MET-KC-080) revoked all COVID-19 executive orders as of March 31, 2021, required board-of-county-commissioners approval of local health officer orders and created expedited judicial review of county and school-district orders; the Johnson County Local Health Officer's March 25, 2021 order was issued and approved under that regime and expired April 30, 2021, and the Board of Health's school order 001-21 (August 5, 2021) was challenged under SB 40 in the Johnson County District Court (M.M.C., September 2021) while the Kansas Supreme Court's August 24, 2021 stay restored SB 40's review procedure (Ex. MET-KC-082, secondary). The Kansas state of disaster emergency expired June 15, 2021.
