Operative words

During the public health emergency, employers in the District shall adopt and implement social distancing and workplace protection policies to prevent transmission of COVID-19 in the workplace in accordance with the requirements of all applicable Mayor's Orders.

Penalty

Attorney General investigation, subpoena and civil action (sec. 105); private right of action in the Superior Court within one year for reasonable attorneys' fees and costs, lost wages and benefits and equitable relief (sec. 106)

What it required

Continued on a 225-day temporary basis the employer command of D.C. Act 24-26: policies 'in accordance with the requirements of all applicable Mayor's Orders'; protection of employees for 'workplace health and safety practices related to COVID-19', defined by reference to 'federal or District law or regulations or Mayor's Orders, a standard issued by OSHA, or a recommendation by the CDC or WHO intended to make the transmission of COVID-19 between persons less likely'; Attorney General enforcement and a private right of action.

Sec. 101(16) defines the operative period by reference to Mayor's Order 2020-045 'and all subsequent extensions'; Mayor's Order 2020-045 (the public emergency) was extended through Oct. 8, 2021 (Ex. DC-021) and Jan. 7, 2022 (Ex. DC-022), while Mayor's Order 2021-096 terminated the separate public health emergency declared by Mayor's Order 2020-046 effective July 25, 2021 (Ex. DC-021).
