The record in brief

The District of Columbia governed the pandemic through a single chain of Mayor's Orders issued under section 422 of the Home Rule Act, the District of Columbia Public Emergency Act of 1980 (D.C. Official Code 7-2304 and 7-2304.01) and the Communicable and Preventable Diseases Act (D.C. Official Code 7-131 et seq.), with the Council of the District of Columbia enacting successive emergency acts that authorized each extension of the public emergency and the public health emergency beyond the fifteen days the Mayor may declare alone. Mayor's Orders 2020-045 and 2020-046 (March 11, 2020) declared a public emergency and a public health emergency; Mayor's Order 2020-048 (March 16) prohibited mass gatherings of fifty or more, suspended table seating at every licensed restaurant and tavern from 10:00 p.m. that night and closed nightclubs, health clubs and theatres; Mayor's Order 2020-051 (March 20) re-issued those prohibitions through April 24; Mayor's Order 2020-053 (March 24) ordered every business with a facility in the District, other than an Essential Business, to cease all activities at those facilities except Minimum Basic Operations by 10:00 p.m. on March 25, prohibited gatherings of ten or more and required essential and non-essential businesses alike to take all reasonable steps necessary for employees to work remotely; Mayor's Order 2020-054 (March 30) ordered all individuals living in the District to stay at their place of residence from 12:01 a.m. on April 1, on pain of a $5,000 fine and ninety days' imprisonment. Mayor's Orders 2020-063 (April 15), 2020-066 (May 13) and 2020-067 (May 27) extended the emergencies and the stay-at-home regime through May 15, June 8 and, for the emergencies, July 24, 2020. 2020 Q2 therefore opened under a stay-at-home order and a non-essential business closure and closed under Phase Two. Phase One (Mayor's Order 2020-067, effective May 29, 2020) repealed the stay-at-home sections but kept the ten-person gathering prohibition, confined non-essential retail to curbside and delivery, allowed barbershops and salons by appointment only, allowed outdoor dining only and listed by name the businesses that remained closed (gyms, theatres, bars and nightclubs, clothing and jewelry stores, museums, travel agencies, professional services other than those provided to essential businesses). Phase Two (Mayor's Order 2020-075, effective June 22, 2020) replaced the ten-person limit with a prohibition on mass gatherings of more than fifty, opened non-essential retail at fifty percent of occupancy, opened indoor dining at fifty percent with seated service only and no bar seating, capped worship at fifty percent or one hundred persons, capped gyms at five persons per thousand square feet, kept bars, nightclubs, theatres, cinemas and entertainment venues closed absent a waiver, ordered residents of nursing homes and assisted living to stay at home, and ordered that businesses 'shall continue to have employees telework to the greatest extent consistent with their business operations.' Phase Two, as modified, governed the District from June 22, 2020 until May 21, 2021. 2020 Q3 added the universal mask order (Mayor's Order 2020-080, July 22, 2020: businesses shall post signage and exclude persons not wearing masks; employers shall provide masks; fines of up to $1,000) and the travel self-quarantine order (Mayor's Order 2020-081, effective July 27, 2020: fourteen days after non-essential travel from any State with ten or more new daily cases per 100,000), and extended the emergencies through October 9, 2020 (Mayor's Order 2020-079). 2020 Q4 extended the emergencies through December 31 and re-wrote the telework clause to 'Businesses shall have employees and contractors telework to the extent that is consistent with their current business operations' (Mayor's Order 2020-103, October 7); replaced the quarantine with a pre- and post-arrival testing regime (Mayor's Order 2020-110, effective November 9); and then re-tightened for the winter: alcohol sales ended at 10:00 p.m., indoor dining fell to twenty-five percent from December 14, indoor gatherings fell to ten, outdoor gatherings to twenty-five, indoor group fitness classes were suspended and telework was again 'strongly encourage[d]' (Mayor's Order 2020-119, effective November 25); high-contact sports were prohibited (Mayor's Order 2020-123, effective December 11); a twenty-five percent or 250-person cap was imposed on worship, gyms, food retailers, restaurants and libraries (Mayor's Order 2020-126, effective December 17); and a holiday pause (Mayor's Order 2020-127) closed indoor dining, museums and libraries and 'required' non-essential businesses to telework from 10:00 p.m. on December 23, 2020, extended to 5:00 a.m. on January 22, 2021 by Mayor's Order 2021-004. 2021 Q1 opened under that pause and continued under the twenty-five percent regime; Mayor's Order 2021-038 (March 17, 2021, effective March 22) extended the emergencies through May 20, 2021, raised outdoor gatherings to fifty, removed the telework encouragement and directed businesses to 'implement plans to safely increase the presence of on-site employees,' and kept retail, restaurants, gyms, worship and recreation at twenty-five percent or 250, bars and nightclubs closed, indoor gatherings at ten and the travel-testing rule in force. 2021 Q2 saw the easing of May 1 (retail fifty percent; venues twenty-five percent; worship forty percent) and Mayor's Order 2021-069 (May 17, 2021), which lifted capacity, activity and time restrictions on most public and commercial activity at 5:00 a.m. on May 21, 2021 and on nightclubs and large venues on June 11, 2021, while extending the public health emergency to July 25, 2021 and keeping mask requirements for unvaccinated persons and in transit, health care, school, child care and District government settings. 2021 Q3 opened under the continuing public health emergency, the modified mask rules and the Superior Court's and Court of Appeals' operating orders; Mayor's Order 2021-096 (July 24) ended the public health emergency at 12:01 a.m. on July 25, 2021 but extended the public emergency to October 8, 2021 and reserved the authority to 'establish mask requirements' and 'establish vaccination requirements'; Mayor's Order 2021-097 (July 29) re-imposed a universal indoor mask requirement from 5:00 a.m. on July 31, 2021 ('All persons must wear masks indoors as prescribed by DC Health guidance'), made DC Health's compulsory guidance 'lawful regulations,' delegated school and child-care masking to OSSE and DC Health and carried a $1,000 fine and license suspension; the Mayor then required every District government employee to be vaccinated by September 19, 2021 (announced August 10), every health care worker to receive a first dose by September 30, 2021 (announced with DC Health August 16), and every adult regularly in a school or child care facility to be vaccinated by November 1, 2021 (Mayor's Order of September 20, 2021). The indoor mask mandate ran to November 22, 2021 and the public emergency to January 7, 2022 (Mayor's Order 2021-119, October 7, 2021). The District of Columbia Courts suspended non-priority matters and tolled every statutory and rule-based deadline from March 18, 2020, required masks in every court building from June 26, 2020, kept the Court of Appeals' courthouse closed to the public until July 12, 2021, and kept deadlines tolled until at least November 21, 2021.

What remained in force

The public health emergency through July 25, 2021 and the public emergency through January 7, 2022 and beyond; mask requirements for persons not fully vaccinated and, for all persons, on public transit, in health care settings, in schools and child care facilities, in District government facilities with public contact and wherever an establishment required them (Ex. DC-073); the universal indoor mask requirement from July 31, 2021 (Ex. DC-057) with DC Health's mandatory mask guidance of July 30, 2021 (Ex. DC-077); the Superior Court's and Court of Appeals' operating orders (Exs. DC-026, DC-028, DC-059, DC-060, DC-061); DC Health quarantine and isolation guidance; and, from August and September 2021, the vaccination requirements for District employees, health care workers and school and child care personnel (Exs. DC-075, DC-076).

Preemption of local orders

Not applicable in form: the District of Columbia has no counties or municipalities, so the Mayor's Orders are simultaneously the State-level and the local layer, and no lower authority could issue a conflicting order. Two features substitute for a preemption analysis. First, the Council of the District of Columbia controlled the duration of every emergency: D.C. Official Code 7-2306 permits the Mayor to declare a public emergency for fifteen days, and each extension recited in the orders rests on a Council emergency act (D.C. Act 23-247, March 17, 2020; D.C. Act 23-286, April 2020; D.C. Act 23-326 and 23-328, May-June 2020; D.C. Act 23-335, July 7, 2020; D.C. Act 23-405, August 19, 2020; D.C. Act 23-411, October 5, 2020; D.C. Act 23-524, December 21, 2020; D.C. Act 24-30, March 17, 2021; D.C. Act 24-79, May 10, 2021; D.C. Act 24-125, July 24, 2021; D.C. Act 24-178, October 7, 2021), so the District's orders were the product of both the executive and the legislature. Second, the federal enclave: the orders exempt 'Gatherings on property within the District of Columbia owned by the federal government' (Mayor's Order 2020-053, sec. IV.3.b.iv; Mayor's Order 2020-075, sec. XV.1.b.iii) and provide that their enforcement provisions 'shall not apply to any employees of the federal government while they are on duty' (Mayor's Orders 2020-080, sec. IV.2; 2021-038, sec. XV.2; 2021-097, sec. V.4). every District employer whose customers, tenants or counterparties were federal agencies felt both layers at once.

Travel and quarantine

Essential Travel defined and all other travel barred by the stay-at-home order April 1 to May 29, 2020 (MO 2020-054 sec. IV.5); fourteen-day self-quarantine after non-essential travel from any State with ten or more daily cases per 100,000 from July 27, 2020 (MO 2020-081; Maryland and Virginia exempt); pre-arrival test within seventy-two hours for visitors and post-arrival test within three to five days for returning residents from November 9, 2020 (MO 2020-110; DC Health travel guidance December 14, 2020, DC-050); fully vaccinated travelers exempted March 17, 2021 (MO 2021-038 sec. Face coverings

Masks for taxi and ride-share passengers and for food-seller, hotel and transport employees from April 9-17, 2020 (MO 2020-058, 2020-063); masks for all individuals when likely in the presence of others and for all Essential Business employees, with signage and exclusion of unmasked customers, from May 16, 2020 (MO 2020-066 secs. III-IV); consolidated universal order July 22, 2020 with $1,000 fines (MO 2020-080), carried forward in MO 2021-038 sec. Vaccination mandates

District government employees (agencies reporting to the Mayor, about 32,700 employees): fully vaccinated by September 19, 2021, announced August 10, 2021, with weekly testing thereafter for the unvaccinated (DC-076); all licensed, certified and registered health professionals, EMS providers and unlicensed health care workers: first dose by September 30, 2021, announced with DC Health August 16, 2021 (DC-075); all adults regularly in schools and child care facilities and student athletes twelve and over: by November 1, 2021, Mayor's Order of September 20, 2021 (DC-076); Mayor's Order 2021-119 (October 7, 2021) recites all three as in force (DC-022); vaccination-proof for entry to indoor establishments Mayor's Order 2021-148 (December 22, 2021; post-period; DC-058).

Standing duties

The statutes, codes and penalty provisions of District of Columbia that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the District of Columbia duties →

The District of Columbia bound its employers by statute, not by exhortation. The Public Emergency Act empowers the Mayor to order measures protecting persons and property, to control the sale and distribution of goods and services and to direct any person conducting business to alter hours or observe a curfew (D.C. Code 7-2304(b)(3), (6), (7)); the public health emergency order adds detention, licensure and liability terms (7-2304.01); and 7-2307 makes every emergency executive order enforceable by a fine of not more than $1,000 for each violation and by a civil action in the name of the District. From March 17, 2020 the Council added, and renewed without interruption through 2021, two temporary paragraphs: the Mayor may revoke, suspend or limit the licence, permit or certificate of occupancy of any person or entity that violates an emergency executive order, and a violation of any rule, order or other issuance under an emergency order is a violation of the order itself. The Communicable and Preventable Diseases Act of 1939 (7-131 et seq.) supplies rulemaking power over restriction of movement, isolation and quarantine, removal and area-detention orders, a prohibition on obstructing or interfering with health enforcement, and criminal penalties of $5,000 and ninety days ($1,000 and thirty days for violating a rule). On the workplace, the District's own general-duty clause (32-1103) is marked Not Applicable because no State plan was ever approved, so 29 U.S.C. 654(a)(1) governs every District private employer directly; on top of it the Council enacted, effective August 20, 2020 and continuously renewed through the period, a statutory command that employers 'shall adopt and implement social distancing and worker protection policies... that adhere to the requirements of Mayor's Order 2020-080, or subsequent Mayor's Order' (from February 26, 2021, 'in accordance with the requirements of all applicable Mayor's Orders'), enforced by administrative penalties, Attorney General suits and a private right of action. The only liability exemption the District enacted for persons generally reaches actions taken 'to implement the provisions of the District of Columbia response plan and of' the communicable-disease law, except gross negligence, and solely during the public health emergency: protection turned on implementing the District's controls. Every reopening order made continued operation conditional on protocols stated with 'shall' and 'must', incorporated DC Health guidance by reference with 'must be followed', and in July 2021 declared that compulsory statements in DC Health guidance 'are to be treated as lawful regulations.' The District Court for the District of Columbia recorded that a congregation contravening the restrictions faced 'fines of $1,000 per violation, D.C. Code 7-2307', and the Attorney General sued gyms under the Emergency Act, obtaining consent terms and a $10,000 penalty. Nothing a District employer did to comply with these instruments was voluntary.
