Operative words

1. Each employer shall furnish to each of the employer's employees employment and a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to the employer's employees and comply with occupational safety and health standards promulgated under this chapter.

Penalty

Iowa Code § 88.14: civil penalties for willful or repeated violations of § 88.4 or any standard, at the minimum and maximum amounts set by the U.S. Department of Labor under 29 U.S.C. § 666 as adjusted (in 2020-2021: up to $13,494 per serious violation; up to $134,937 per willful or repeated violation; federal figures, not separately exhibited); serious, nonserious and failure-to-correct penalties (§ 88.14(2)-(4)).

What it required

Bound every Iowa private-sector and public employer to abate recognized hazards likely to cause death or serious physical harm and to comply with the Iowa standards (which adopt every federal Part 1910 standard by reference, DUT-IA-018), enforced by the Iowa Division of Labor (Iowa OSHA) through citations and civil penalties.

Iowa Code § 88.4(1) is the State-law counterpart of 29 U.S.C. § 654(a)(1). Iowa OSHA conducted COVID-19 inspections of meatpacking plants in 2020 (Tyson Waterloo, April 20, 2020; Iowa Premium, Tama, citation of Sept. 2020) per contemporaneous reports (not saved; verified_secondary).
