Operative words

The county or joint board of health or local health officer is hereby empowered and authorized to prohibit public gatherings when necessary for the control of any and all infectious or contagious disease. [K.S.A. 65-119(a), period text, shown struck by § 2 and replaced with 'may recommend against']

Supplies, from the Legislature's own document, the 2020-2021 text of the three sections the 2025 act rewrote: the Secretary's power to 'take action to prevent the introduction... and to prevent the spread of infectious or contagious disease' (65-101(a)(5)), the local board's and health officer's power to prohibit public gatherings and duty to see that isolation, restriction of communication, quarantine and disinfection 'are duly enforced' (65-119(a)), and the isolation-and-quarantine order power over 'an individual or group of individuals' with law-enforcement assistance (65-129b(a)(1)(B), (a)(2)). Filed because the Revisor's current pages for 65-101, 65-119 and 65-129b carry the 2025 amendments and the Legislature's archived 2019-2020 and 2021-2022 statute pages for these three sections return 404. Read the struck text on the PDF image, not the text layer. The 65-101 text through March 24, 2021 is also shown, with SB 40's insertions, in KS-040 § 11; the 65-129b text is confirmed by FindLaw's mirror current as of Jan. 1, 2025 (DUT-KS-007) and by the Attorney General's verbatim quotation of (a)(1)(B) and (a)(2) (DUT-KS-017 at 9-10).
