Operative words

Except as otherwise provided by this code, a person who violates a rule or order of the department is guilty of a misdemeanor punishable by imprisonment for not more than 6 months, or a fine of not more than $200.00, or both.

What it required

Made every violation of an MDHHS order, including every epidemic order under MCL 333.2253, a misdemeanor; recited verbatim in the implementation section of every MDHHS gathering and face-covering order (Exs. MI-050 sec. 6(e); MI-060 sec. 8(e)).

Retrieval note

The Court of Appeals noted that 'the Order in question contained criminal sanctions for violators of the Order' (Ex. DUT-MI-019 at 14), which is this section.
