Operative words

(2)... a person who violates the provisions of this chapter or rules adopted by the department under the provisions of this chapter is guilty of a misdemeanor. On conviction, the person shall be fined not less than $10 or more than $500 or be imprisoned for not more than 90 days, or both. (3) Each day of violation constitutes a separate offense.

What it required

Violation of chapter 2 (which includes the health officers' closure, gathering, quarantine and compliance orders under 50-2-118) or of DPHHS rules under it is a misdemeanor, each day a separate offense; the 2021 text adds civil penalties for violating a local board's rules ($10 to $200 for a person; up to $250 for a 'business entity', defined in (6) to include corporations, LLCs and sole proprietorships).

Retrieval note

Ten library records (Yellowstone, Gallatin and other county orders) recite 50-2-124 as their penalty. The pre-2021 text, under which violation of local board rules was itself the misdemeanor, was not re-read in this run (Internet Archive offline); the History line places the restructuring in Ch. 408, L. 2021, the same act as 50-2-116(5) (Ex. MT-073).
