Operative words
The department may adopt and enforce quarantine or isolation measures to prevent the spread of communicable disease. A person who does not comply with quarantine measures shall, on conviction, be fined not less than $10 or more than $100.
Penalty
Fine of $10 to $100 on conviction (50-1-204); 'violate a quarantine regulation' is unlawful under 50-2-122 and a misdemeanor under 50-2-124(2) (up to $500 and 90 days, each day a separate offense; DUT-MT-007)
What it required
DPHHS may adopt and enforce quarantine and isolation measures against any person, and noncompliance is a criminal offense; the Directive of March 30, 2020 quarantining every non-work arrival for fourteen days (Ex. MT-010) and the local isolation and quarantine orders of every quarter through 2021 Q3 rest on this section, 50-2-116(1)(c)(iii) and 50-2-118(1)(d).
Retrieval note50-1-101(6) defines 'isolation' as 'the physical separation and confinement of an individual or groups of individuals who are infected with a communicable disease from nonisolated individuals to prevent or limit the transmission of the communicable disease' (read at the same site; not saved).
