Operative words
Every person who willfully exposes himself or another person, being affected with any contagious disease in any public place or thoroughfare, except in his necessary removal in a manner not dangerous to the public health, is guilty of a misdemeanor.
Penalty
What it required
No person may willfully bring a person affected with a contagious disease into a public place, which binds an employer that would require a symptomatic or diagnosed employee to report to a workplace open to the public and is the criminal backdrop of every screening and exclusion protocol.
Retrieval note21 O.S. 1191 (read, not saved) makes it a misdemeanor to maintain any public nuisance or to 'willfully omit to perform any legal duty relating to the removal of a public nuisance'; 50 O.S. 1 (read, not saved) defines a nuisance as 'unlawfully doing an act, or omitting to perform a duty, which act or omission... endangers the comfort, repose, health, or safety of others'.
