Penalty
Class C misdemeanor for violating ORS 624.010-624.121 or OHA rules under them (624.990(1)); civil penalty (624.992(1)); license revocation or suspension after up to 14 days to correct (624.073(1)); immediate closure for an imminent or present danger (624.073(2)); summary closure of temporary restaurants (624.096).
What it required
Forbade any person with a communicable disease defined by OHA rule (OAR 333-019-0010(1)(b)(A), which named COVID-19 from April 6, 2020) to work in any restaurant, forbade every restaurant to employ a person 'affected with, carries or is suspected of being affected with or carrying any communicable disease,' commanded the manager to notify OHA 'immediately' on suspicion and to post the subsection in every toilet room (624.080(2)), authorized OHA to order the 'immediate exclusion of the employee' and medical examination of the employee and associates (624.080(3)), authorized suspension or revocation of the license for an uncorrected critical violation and 'immediate correction... or closure' for a critical violation that 'constitutes an imminent or present danger to the public health' (624.073(1)-(2)), and required OHA to make sanitation rules on 'The cleanliness of the premises' and 'The cleanliness and grooming of food workers' (624.041(4), (9)).

OHA's Food Sanitation Rules (OAR chapter 333, division 150, adopting the FDA Food Code) were not saved; ORS 624.080(1) delegates the definition of the excluded diseases to OHA rule, which is OAR 333-019-0010 (DUT-OR-006). OLCC enforced the Governor's restaurant and bar directives under the liquor code as a parallel vehicle (OAR 845-006-0345(15)-(17); DUT-OR-016 to DUT-OR-018; Ex. OR-034).
