Operative words
If you choose to reopen during these new regulations, you will need to submit a COVID-19 plan prior to opening.... Yes, monitoring visits will continue to occur. These visits will include a short-flow monitoring form based on the new regulations and other active high-risk regulations.
Penalty
licensure enforcement (monitoring visits; plan approval as the condition of operating); no reimbursement for closed providers
What it required
A State agency's FAQ of the period stating the operating condition in terms: a licensed child-care provider could reopen only after submitting a COVID-19 plan for approval under the emergency regulations, at reduced licensed capacities posted with the license, in stable groups, with staff masked ('we are asking the staff that care for children to wear masks'), with mandatory pre-submission webinars ('you will be required to participate in two webinars'), and subject to monitoring visits enforcing 'the new regulations'; providers that stayed closed were not reimbursed for subsidized children. Character as recorded: agency_position_statement (release, FAQ, memorandum or statement; order_operating_condition layer).
Retrieval noteThe document's face is the DHS child-care re-opening FAQ updated May 10, 2020, and it is recorded as such. The mask statement is a request ('we are asking'), recorded as recommended in character; the plan-submission and webinar statements are mandatory ('will need to,' 'will be required to').
