The record in brief

Rhode Island governed the pandemic by a single unbroken chain of gubernatorial orders under R.I. Gen. Laws tit. 30, ch. 15 and tit. 23, ch. 8, supplemented by Department of Health emergency regulations carrying civil fines, by orders of the Chief Justice under § 8-15-2, by DMV, DBR and DHS instruments, and by the City of Providence's own emergency orders. Governor Raimondo declared a disaster emergency on March 9, 2020 (EO 20-02, Ex. RI-001); the declaration was renewed every month through September 30, 2021 and beyond (Ex. RI-048, RI-051, RI-061, RI-065). 2020 Q2 (with the March 13-31 run-up): international arrivals quarantined from March 13 (EO 20-03); gatherings of 25 or more prohibited and every dining room and bar closed to on-premises consumption from March 17 (EO 20-04, Ex. RI-003); theaters, cinemas, sporting events, bowling alleys, museums, gyms, salons, barbers, nail salons, spas and tattoo parlors ordered to cease in-person operations by 5:00 p.m. March 23, and every business-service employee who could work from home 'required to do so' (EO 20-09, Ex. RI-006); a stay-at-home order for all residents, a five-person gathering cap, closure of all non-critical retail from March 30, a compelled-telecommuting rule for interstate employees and a 14-day quarantine for every non-work arrival from any State (EO 20-13/20-14, Ex. RI-009, RI-010), extended to May 8, 2020 (EO 20-23, Ex. RI-014). Masks were compelled at work from April 18 (EO 20-24, Ex. RI-015) and in public from May 8 (EO 20-30, Ex. RI-016). Phase I (EO 20-32, May 9, Ex. RI-017) lifted the stay-home order but kept the five-person cap, the traveler quarantine, retail at one customer per 300 square feet, recreation and close-contact businesses closed, offices told that anyone who can work remotely 'should continue to do so', and elective medical procedures resumed only under RIDOH-approved plans; RIDOH's Safe Activities regulation, 216-RICR-50-15-7 (Ex. RI-069), took effect the same day and made a written COVID-19 plan, screening of every entrant, mask instruction, signage and records a condition of opening any establishment, enforceable by closure and per-day fines. Phase II (EO 20-40, June 1, Ex. RI-019): gatherings 15, offices at 33%, indoor dining 50%, salons and gyms reopened under regulation. 2020 Q3: Phase III (EO 20-50, June 30, Ex. RI-021; re-issued as EO 20-58, 20-67, 20-88) fixed indoor social gatherings at 25 and outdoor at 50, venues and worship at 66% with caps of 125 indoors and 250 outdoors, offices at 66% with working from home 'still strongly encouraged', indoor dining at 66% with no standing bar service; bars closed their bar areas at 11:00 p.m. from August 6 (EO 20-61, Ex. RI-022); the quarantine-and-isolation order and the hot-spot traveler quarantine were restated September 3 (EO 20-71, Ex. RI-024) and the Governor suspended the APA's renewal limit so that every COVID-19 emergency rule could be renewed indefinitely (EO 20-72, Ex. RI-025). 2020 Q4: the winter re-tightening ran in four steps: gatherings cut to ten on October 30 (EO 20-90, Ex. RI-026); a 10:00 p.m. stay-home advisory, venues and worship cut to 50% and early closing of restaurants and bars from November 8 (EO 20-95, Ex. RI-027); gatherings limited to a single household and employers ordered to cancel non-essential travel from November 19 (EO 20-98, Ex. RI-028); and 'Rhode Island on Pause' from November 30 to December 20 (EO 20-100, 20-105, Ex. RI-029, RI-031), which closed every indoor and outdoor venue of assembly, every indoor recreation and entertainment business and every bar area, cut indoor dining to 33% with one household per table and a 10:00 p.m. cutoff, put worship at 25%, retail at one customer per 100 square feet, and made telework compulsory: 'employees who are able to work remotely are required to do so during the Pause.' Protecting Your Household (EO 20-108, effective December 21, Ex. RI-032) kept compelled telework, single-household gatherings, venues at 25%, dining at 50% with the 10:00 p.m. close and closed bar areas. 2021 Q1: that regime, revised January 29 and February 5 and restated February 25 (EO 21-09, 21-18, Ex. RI-034, RI-035), moved to two-household indoor gatherings, venues and worship at 40%, offices at 33% on site and a 10-day traveler quarantine with test-out, then to the amended orders of March 5-April 30; the quarantine-and-isolation order was restated March 19 (EO 21-26, Ex. RI-036). 2021 Q2: capacity rose to 80% on May 7 (EO 21-46, Ex. RI-037; gatherings 25 indoors and 75 outdoors, venues capped at 500); the Reopening Order of May 21 (EO 21-57, Ex. RI-040) dropped the percentage caps and gathering limits but kept the international and hot-spot quarantines, required every establishment to comply with RIDOH's screening, masking and signage regulations and to remind unvaccinated persons to mask, held nightclubs at 50% absent proof of vaccination, and kept the Enforcement Task Force's inspections, compliance orders and civil fines; masks remained compulsory indoors for the unvaccinated and on all transit (EO 21-63, 21-69, Ex. RI-042, RI-044). 2021 Q3: the Reopening Order, the mask order and the traveler quarantines were in force July 1-6 (EO 21-68, 21-69, 21-75, Ex. RI-043, RI-044, RI-046) and were terminated July 6, 2021 by EO 21-76 (Ex. RI-047) under Section 3 of the FY2022 Appropriations Act, 2021-H 6122Aaa (Ex. RI-073), which capped emergency powers at 180 days and expressly permitted the quarantine-and-isolation order (21-26), the emergency-regulation renewals (20-72), the hospital capacity order (21-67), the public-meetings order (20-46) and others to run to September 1, 2021. After July 6 the following force-of-law instruments remained: the disaster emergency (EO 20-02, extended July 8, Aug. 6, Sept. 3 and Sept. 30); the quarantine-and-isolation order (EO 21-26, extended July 14 and Aug. 12 to Sept. 1, then EO 21-93 of Sept. 1, 21-94 of Sept. 2 and 21-100 of Sept. 30, Ex. RI-049, RI-052, RI-059, RI-060, RI-066), which quarantined every unvaccinated close contact for 10 days and masked every vaccinated one for 14; the RIDOH Safe Activities regulation, in force to August 31, 2021 (Ex. RI-071), requiring masks of the unvaccinated in every establishment, entrance screening notices and denial of access to the symptomatic; the emergency-regulation renewal order (EO 20-72, extended July 16 and Aug. 16 to Sept. 1); the hospital licensing and certificate-of-need suspensions (EO 21-67, 21-81, 21-91); a new Declaration of Disaster Emergency for the Delta variant on August 19 (EO 21-86, Ex. RI-054) with a universal K-12 masking mandate the same day (EO 21-87, Ex. RI-055, extended Sept. 17 and Oct. 15); RIDOH's health-care-worker vaccination rule of August 17 (216-RICR-20-15-8, Ex. RI-072: twice-weekly testing and masks for unvaccinated staff at once, vaccination by October 1, 2021, facilities to deny entrance thereafter); the Supreme Court's screening-and-mask order of July 20 and universal courthouse masking from August 13 (Ex. RI-084, RI-085); and Providence's continuing emergency orders of June 15, July 15 and August 14, 2021 (Ex. RI-098 to RI-100), which kept City buildings at limited capacity and every public event under State guidelines and a City permit. End of general restrictions

Instrument Executive Order 21-76 (July 6, 2021), issued 'pursuant to Section 3 of the Appropriations Act' (2021-H 6122Aaa, art. 3, § 3, signed July 6, 2021), terminating the Reopening Order (EO 21-68), the mask order (EO 21-69), EO 21-75 and EOs 20-06, 20-16, 20-17 and 20-39. The capacity and gathering limits had already been dropped by the Reopening Order of May 21, 2021 (EO 21-57), which carried none other than the nightclub rule.

Preemption of local orders

No Rhode Island instrument preempted or barred local COVID-19 orders. Rhode Island has no county government; its thirty-nine cities and towns act under R.I. Gen. Laws § 30-15-13 (local disaster emergencies) and their charters. The Governor's orders assumed concurrent local action: the Phase orders conditioned expanded outdoor dining on 'applicable municipal approval' (EO 20-40 ¶12; 20-50 ¶17; 20-100 ¶26), the 2021 venue rules referred to conditions 'specified by DBR and/or the applicable municipality' (EO 21-46 ¶9), and the school-masking order of Aug. 19, 2021 applied to 'LEAs that have not adopted a universal indoor masking requirement' (EO 21-87 ¶1), a State floor beneath local mandates. Providence's twenty-eight supplemental emergency orders (Mar. 12, 2020 - Aug. 14, 2021) were each issued 'consistent with the emergency directives of the State of Rhode Island' and at times ran ahead of the State (the Providence Place Mall closed Mar. 17, 2020; salons and gyms closed Mar. 21, 2020; a universal mask order effective May 9, 2020) or added local conditions (City approval for catered events over 10 indoors or 25 outdoors from Nov. 22, 2020; special event permits; a bar on cruise passenger vessels at the Port of Providence; City buildings at limited capacity through Sept. 14, 2021). The only legislative limit on emergency powers, 2021-H 6122Aaa art. 3 § 3 (July 6, 2021), constrained the Governor, not the municipalities.

Standing duties

The statutes, codes and penalty provisions of Rhode Island that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Rhode Island duties →

Rhode Island's compulsion ran on four standing tracks, every one of them older than COVID-19 and every one of them recited or invoked by the emergency instruments already in the Orders Library. First, the Department of Health's organic act: R.I. Gen. Laws § 23-1-1 commands the department to 'adopt proper and expedient measures to prevent and control diseases and conditions detrimental to the public health in the state' (Ex. DUT-RI-001); § 23-1-17 authorizes rules fixing 'minimum sanitary requirements' and their enforcement by license suspension (DUT-RI-002); § 23-1-18(1)-(2) authorizes rules 'fixing responsibilities of owners, operators, and occupants of land or buildings for the sanitary condition, maintenance, use, and occupancy of the land and buildings' and 'the quarantine of persons' (DUT-RI-003); § 23-1-21 lets the director close an establishment by 'immediate compliance order' without prior notice or hearing (DUT-RI-004); and § 23-1-25 makes violation of any rule of the director a crime, each day a separate offense (DUT-RI-014). RIDOH's Safe Activities regulation, 216-RICR-50-15-7 (Ex. RI-069 to RI-071), was promulgated under §§ 23-1-1 and 23-1-17, closed establishments under § 23-1-21 (§ 7.5) and stacked its civil fines on the criminal penalties of title 23 (§ 7.6(E)); every executive order directed the Enforcement Task Force to 'issue compliance orders under Chapter 1 of Title 23' (RI-017 ¶ 18; RI-043 ¶ 11). Second, the quarantine chapter: § 23-8-4 (isolation, quarantine, 'exclusion or other protective actions') (DUT-RI-005), § 23-8-7 (penalty) (DUT-RI-006) and § 23-8-18, under which the Governor may 'place under quarantine the whole state' and 'shall authorize and empower the state director of health to take any action and make and enforce any rules and regulations that may be deemed necessary to prevent the introduction and to restrict the spread of infectious diseases' (DUT-RI-007); the orders' recurring clause authorizing the RIDOH Director 'to take any action and make and enforce any rules and regulations necessary to implement this Executive Order' (RI-006 ¶ 7; RI-016 ¶ 4) is § 23-8-18's own language, and every order recited 'Title 23, Chapter 8' as authority. Third, the Emergency Management Act: § 30-15-7(1) gives executive orders 'the force and effect of law' (DUT-RI-009); § 30-15-9(e)(7) lets the Governor 'control ingress and egress to and from a high risk area, the movement of persons within the area, and the occupancy of premises therein' and (e)(11) makes it 'the duty of state health authorities and the local code enforcement officials to make and enforce rules and regulations designed to prevent the introduction of any contagious or infectious disease' (DUT-RI-008); § 30-15-21 punishes 'any person violating... any rule, order, or regulation promulgated pursuant to this chapter' with $500 and ninety days (DUT-RI-010); and the General Assembly ratified the orders on July 6, 2021, providing that the quarantine, emergency-regulation and hospital orders 'shall remain in effect' to September 1, 2021 (RI-073; § 30-15-9(h)). Fourth, the workplace: § 28-20-8 commands that 'Each employer shall furnish to each of his or her employees a place of employment that is free from recognized safety and health hazards' (DUT-RI-012), a chapter that 'shall apply to every employer now or subsequently doing business in this state' (§ 28-20-7, DUT-RI-015) with civil penalties to $10,000 (§ 28-20-18, DUT-RI-013); Rhode Island has no OSHA State plan for private employers, so the identical federal duty, 29 U.S.C. § 654(a)(1) (Ex. DUT-AL-009), bound them directly. Rhode Island's COVID-19 workplace rules were the mask-at-work order, EO 20-24 ('All such businesses must provide, at their expense, face coverings'; RI-015), and the Safe Activities regulation, which made every covered entity's continued operation conditional on a written COVID-19 Control Plan meeting 'at a minimum, the requirements of these regulations and applicable guidance issued by the Department,' entry screening, face coverings, signage, daily cleaning, records and cooperation with case investigation (RI-069 § 7.4(A)). Rhode Island enacted no general business liability shield in 2020 or 2021; its standing shield, § 30-15-15(a), protects only a 'disaster response worker complying with, or reasonably attempting to comply with this chapter, or any order, rule, or regulation promulgated pursuant to' it (DUT-RI-011), and EO 20-21 declared the health care sector to be performing 'disaster response services within the meaning of R.I. Gen. Laws 30-15-15' (RI-013): compliance with the orders was the price of immunity. The food-establishment chapter independently forbade operating a food business 'except in compliance with... the regulations' (§ 21-27-2, DUT-RI-017) and armed the director with a notice to cease business (§ 21-27-5, DUT-RI-016). The State's own reopening guidance told every business that the guidelines 'should be considered the minimum' (Phase I, May 13, 2020, DUT-RI-018) and then 'must be considered the minimum' (Phase II, May 28, 2020, DUT-RI-020), that businesses 'must comply with the RIDOH regulations... and active executive orders,' and that 'All businesses and organizations currently operating must complete the COVID-19 Control Plan template... in order to continue operations.' A measure the Service would call 'beyond the order' was, in Rhode Island, the order's own condition of operating, a regulation's command, or the discharge of a duty the General Laws imposed on every employer and every operator of premises.

The question these duties answer

Whether the measures employers took beyond the four corners of the emergency orders were voluntary within Notice 2021-20 Q&A-14, or were the discharge of standing duties imposed by Rhode Island law and of operating conditions written into the orders themselves.
