Operative words
(1) Class 1 misdemeanor: one year imprisonment in a county jail or two thousand dollars fine, or both; (2) Class 2 misdemeanor: thirty days imprisonment in a county jail or five hundred dollars fine, or both.
Penalty
What it required
Fixes the sanction for every Class 1 misdemeanor created by the health statutes (34-22-18, 34-16-1) at one year and $2,000 and for every Class 2 misdemeanor (34-22-5, 34-18-9, 34-18-32) at thirty days and $500, sets the ceiling for municipal ordinance penalties under 9-19-3, and makes any act prohibited by a statute outside the listed titles a Class 2 misdemeanor where no penalty is stated.
Retrieval noteTitle 34 is within the titles excepted from the default Class 2 misdemeanor rule of the last paragraph, so the health statutes' own penalty clauses (34-22-5, 34-22-18, 34-16-1, 34-18-9, 34-18-32) supply the offenses.
