Operative words

On Friday, March 13, 2020, the President declared a national emergency, which triggers the Secretary's ability to authorize waivers or modifications of certain requirements pursuant to section 1135 of the Social Security Act (the Act). [CMS suspends standard surveys and prioritizes survey activity to immediate jeopardy complaints, infection control surveys and other listed categories for a three-week period, then as extended.]

Enforcement

Governs State Survey Agency operations (federal survey and certification)

Notes

The federal 'court and clerk closure' of health care: routine certification surveys stopped nationwide from March 20, 2020; focused infection-control surveys replaced them; providers seeking initial certification, changes of ownership or revisits waited.
