Operative words
Sec. 12-51. - Sunset Provision. The requirements imposed by this Article shall expire and terminate upon certification by the City of Omaha Health Director to the Mayor that: (1) the positivity rate... equals five percent or less for two consecutive weekly reporting periods...; and (2) the seven-day rolling average of positive cases... per 100,000 population equals 10 or fewer cases for two consecutive weekly reporting periods [substitute Ordinance 42368 as introduced Nov. 10, 2020]; Ord. 42435 (NE-075) recites the codified sunset as 'February 23, 2021' before its February 2021 amendment
Enforcement
Notes
The saved document is the substitute ordinance moved on the Nov. 10, 2020 agenda proposing a metrics-based sunset; the codified text that Ord. 42435 amended carried a Feb. 23, 2021 date, so the requirement ran continuously from Aug. 11, 2020 to May 25, 2021 under one of the two forms
Retrieval noteScanned agenda copy (approved as to form 10/22/2020); whether the metrics-based substitute or a dated extension was the enacted October-November 2020 text is not resolved by the documents retrieved; the continuity of the requirement is proved by NE-075.
