The record in brief

Nebraska never issued a stay-at-home order and never closed 'non-essential' businesses by category; it governed commerce through a single chain of Directed Health Measures (DHMs) ordered by the Department of Health and Human Services (DHHS) under Neb. Rev. Stat. sections 71-502 and 81-601 and 173 Neb. Admin. Code ch. 6, signed by the Chief Medical Officer, each carrying the enforcement formula 'Failure to comply with this Order will result in legal action for enforcement by civil and/or criminal remedies' and directing that 'law enforcement and other Municipal and Local Public Health Department personnel will be required to aid the Department in enforcement.' The predicate was the Governor's Proclamation of a state of emergency of March 13, 2020 under section 81-829.40 (NE-001), ended at 11:59 p.m. June 30, 2021 by Executive Order 21-09 (NE-067). 2020 Q2 (with the March 13-31 run-up): DHM Order 2020-001 (Mar. 19; Cass, Douglas, Sarpy, Washington) prohibited every gathering of more than ten patrons, restricted bars and restaurants to carry-out, drive-through and delivery and alcohol to carry-out (NE-002); Orders 2020-002 through 2020-005 (Mar. 25-31) extended the same terms county group by county group, added a prohibition of all 'elective surgeries and elective procedures' and a 14-day home-quarantine order on positives, symptomatic persons and their households (NE-003 to NE-006); Order 2020-009 (Apr. 3) covered all 93 counties, prohibited 'elective medical and dental surgeries and elective medical and dental procedures,' and ordered every public, private and parochial school to 'cease all in-person instruction, and all extra-curricular activities' through May 31, 2020 (NE-008); Order 2020-010 (Apr. 9) closed salons, barber shops, massage, tattoo, gentlemen's and bottle clubs and indoor theaters and suspended all organized team sports (NE-009; carried forward in NE-010). Local health departments layered their own DHMs beneath the State's (Central District and East Central District Apr. 3, 2020, NE-087, NE-088; Lincoln-Lancaster County Health Department 2020-01 to 2020-02, NE-076). Reopening came by DHHS 'Phases' issued as separate DHMs for each of the nineteen local health districts: Phase I from May 4, 2020 (ten districts; restaurants at 50 percent with six-person seated parties, salons masked, child care fifteen per room, schools closed, team sports suspended, theaters and clubs closed; NE-011), May 11 for Lincoln-Lancaster, West Central and Three Rivers (NE-010, NE-077); Phase II from June 1 (gatherings at the greater of 25 persons or 25 percent of rated occupancy not to exceed 3,000; bars at 50 percent seated; gyms and salons at 50 percent; a 14-day quarantine on every person entering Nebraska from an international point of origin; employer congregate-housing screening rules; NE-012, NE-013, NE-078); Phase III from June 22 (89 counties; indoor gatherings 50 percent and outdoor 75 percent not to exceed 10,000; restaurants at 100 percent with eight-person parties; gyms and salons 75 percent; child care 15/20/24/30 per room; elective-surgery restrictions removed; parades, carnivals, dances and beer gardens prohibited; NE-014, NE-016, NE-017); the last four counties joined July 6. 2020 Q3: Phase III governed most of the State through September 13 with its capacity caps, party limits, salon masking, the 500-person (1,000 in Douglas County) 'plan for reopening' approval requirement and the international-travel quarantine (NE-016, NE-017, NE-034); Phase IV from September 14 (all districts, Lancaster's local layer excepted) set indoor gatherings at 75 percent and outdoor at 100 percent and removed the sector sections to guidance (NE-015, NE-018, NE-037, NE-038, NE-039); Lincoln imposed a countywide indoor face-covering mandate by local DHM 2020-07 effective July 20, 2020 (NE-079) and kept stricter gathering caps (the greater of 50 persons or 50 percent indoors) through October (NE-086); Omaha adopted Emergency Ordinance 42309 on August 11, 2020 requiring face coverings indoors in every premises open to the public, on pain of a misdemeanor fine and nuisance abatement (NE-072), after the Douglas County Health Director declined to issue a local mask DHM (NE-097); the quarantine and isolation orders ran throughout. 2020 Q4: the DHMs of October 21 cut indoor gatherings to 50 percent, required patrons to remain seated and conditioned elective procedures on a 10 percent hospital bed reserve (NE-019); the winter re-tightening of November 11 (NE-020, NE-021) cut indoor gatherings to 25 percent of rated occupancy, restored six-foot separation in gyms, restaurants, bars, churches, weddings and funerals, required masks of staff and patrons in salons, barbershops, massage, bowling alleys, pool halls, body-art establishments and 'any other indoor businesses where staff and patrons are within six (6) feet of each other for fifteen (15) consecutive minutes or more,' masked child-care staff, confined youth extracurricular attendance to household members and required hospitals to reserve 10 percent of staffed general and ICU beds; the November 16 DHM paused inpatient elective surgeries (NE-022, NE-090); DHHS published the five-color hospitalization-triggered framework (NE-023) and moved from orange to yellow on December 12 (indoor 50 percent; NE-091) and to blue in late December (indoor 75 percent; NE-092); Lincoln closed its bars in November and reopened them December 18 with a 10:45 p.m. alcohol cutoff (NE-083, NE-084); Omaha extended its mask ordinance to October 20, 2020, to February 23, 2021 and then to May 25, 2021 (NE-073, NE-074, NE-075). 2021 Q1: the blue-phase DHMs (75 percent indoor) ran to January 29; the green-phase DHMs effective January 30, 2021 removed capacity caps but kept, as binding orders, the 500/1,000-person indoor-venue plan-approval requirement, the isolation and quarantine orders on positives, symptomatic persons, close contacts and school-aged individuals, the employer congregate-housing rules and vaccine-provider directives (NE-026, NE-028); Lincoln's local face-covering DHM and 50-percent caps continued; Omaha's ordinance continued. 2021 Q2: the green-phase DHMs ran through April 30 and were renewed to May 31; the Governor ended every remaining DHM at 11:59 p.m. May 24, 2021, the same day EO 21-05 recalled all State employees to in-person work and EO 21-06 set June 1, 2021 rescissions for the alcohol, notary-banking, unemployment and motor-carrier orders (NE-065, NE-066); DHHS confirmed on May 26 that 'Nebraska does not have any statewide health directives' (NE-095); Lincoln lifted its mask DHM May 21, 2021 (NE-108); Omaha's ordinance expired May 25, 2021; the state of emergency ended June 30, 2021 (NE-067). 2021 Q3: no statewide DHM was in force; End of general restrictions

What remained in force

Preemption of local orders

Nebraska did not bar local orders in 2020-2021. The State DHMs were ordered county by county by DHHS under Neb. Rev. Stat. section 71-502 (which commands that 'All officers and other persons shall obey and enforce such communicable disease control rules and regulations as may be adopted and promulgated by the department,' NE-099), and from April 2020 each State DHM recited that it 'does not supersede the provisions of any Directed Health Measure(s) issued by Local Health Departments, except that the Directed Health Measures contained in this order are binding and enforceable regardless of any Directed Health Measure(s) issued by Local Health Departments or municipalities' (NE-008, NE-010): the State order was a floor, and local health departments could be and were stricter. Local public health departments issued their own DHMs under section 71-501 (local boards 'shall make and enforce regulations to prevent the introduction and spread of contagious, infectious, and malignant diseases') and section 71-1630(4), the Central District cited sections 71-1626 through 71-1636 and county and city resolutions (NE-087), the East Central District cited section 71-1631(7) and regulations 'approved by the Nebraska Department of Health and Human Services' (NE-088), and Lincoln-Lancaster cited sections 71-501 and 71-1630(4)(d)(iii), Lincoln Municipal Code ch. 8.18 (section 8.18.140 closure power; section 8.18.170 city-misdemeanor penalty) and Lancaster County Resolution R-07-0035 (NE-076 to NE-079, NE-086). DHHS's own FAQ answered 'Can local governments issue their own Directed Health Measures? A: Yes, local governments can issue their own directed health measures' (NE-029). The one contested question was mask mandates: in July 2020 the Douglas County Board of Health resolved to authorize a county mask DHM, the Health Director declined on July 31, 2020 citing conflicting legal authority after the Attorney General's office questioned a county health director's power to impose one without State concurrence, and the City of Omaha therefore legislated the requirement by home-rule emergency ordinance on August 11, 2020 (NE-072, NE-097); Lincoln issued its mandate as a local DHM under city code (NE-079). No State instrument in the period suspended or voided any local order. The 2022 litigation over the Douglas County Health Director's January 2022 mask mandate and the 2026 amendments to section 71-1630 requiring elected-official approval of community-wide DHMs post-date the claim quarters and are not part of this record.

Never closed by category; retail and grocery stores were carved out of the gathering definition ('typical office environments, factories, or retail or grocery stores where large numbers of people are present but it is typically unusual for them to be within six feet of one another') but 'directed to use heightened, diligent and effective disinfection of exposed surfaces' (NE-002, NE-008); Omaha (Aug. 11, 2020 - May 25, 2021) and Lincoln (July 20, 2020 - May 21, 2021; Aug. 26 - Dec. 23, 2021) required every retail premises open to the public to require face coverings of all persons five and older and to post signage (NE-072, NE-079, NE-086, NE-080); Lincoln prohibited door-to-door sales (NE-076, NE-079).

Courts and public offices

Courts of law were expressly carved out of every DHM gathering definition (NE-002); Lincoln DHMs required face coverings in the Hall of Justice from June 1, 2020 (NE-078, NE-079); EO 20-03 (Mar. 17, 2020 - May 31, 2020), 20-24, 20-34 (to Dec. 31, 2020), 20-36 (Dec. 1, 2020 - Jan. 31, 2021) and 21-02 (to Apr. 30, 2021) waived open-meeting requirements so public bodies met electronically (NE-042, NE-060, NE-061, NE-064); DMV: EO 20-05 (Mar. 19, 2020) extended every title, registration, driver license and CDL expiring on or after Mar. 1, 2020 because 'counties have continued to close local offices,' EO 20-25 for drivers 72 and older, EO 20-30 (July 2, 2020) required renewal by Aug. 31, 2020 reciting that county offices 'had mostly been closed during March, April, and May' (NE-044, NE-055, NE-058); EO 20-16 elections (NE-052).

Travel and quarantine

No interstate travel-quarantine order; Governor's Mar. 24, 2020 request that travelers from outbreak areas self-quarantine was a recommendation (NE-098 source); the Phase II and III DHMs ordered that 'Every individual who enters the State of Nebraska as the final destination from any international point of origin... shall home-quarantine... for a period of no less than fourteen (14) days' June 1 - Sept. 13, 2020 (NE-013, NE-017); EO 20-02 suspended all executive-branch out-of-state travel Mar. 16 - July 7, 2020 (NE-041, NE-059); EO 20-01 and 20-21 waived motor-carrier hours and weight limits for relief hauling (NE-040, NE-054); EO 20-29 TNC waiver (NE-057); isolation and quarantine orders on positives, symptomatic persons, household members and close contacts in every DHM Mar. 25, 2020 - May 24, 2021 (NE-003 to NE-028).

Face coverings

No statewide general mask order. Sector mask orders: salon, barber, massage and tattoo staff and patrons from May 4, 2020 through Jan. 29, 2021 (NE-011, NE-013, NE-017, NE-021); Nov. 11, 2020 - Jan. 29, 2021: also bowling alleys, pool halls, body art and 'any other indoor businesses where staff and patrons are within six (6) feet of each other for fifteen (15) consecutive minutes,' bar patrons playing games, child-care staff, public-facing restaurant staff in the red phase (NE-020, NE-021, NE-023). Local general mask orders: Lincoln-Lancaster County DHM 2020-07 from July 20, 2020 (everyone five and older indoors in premises open to the public unless six feet maintained), continued by 2020-09 and successors, lifted May 21, 2021 (NE-079, NE-086, NE-108); Omaha Emergency Ordinance 42309 from Aug. 11, 2020 (everyone five and older indoors in premises open to the public; misdemeanor fine up to $100 per offense; nuisance abatement), extended to Oct. 20, 2020, Feb. 23, 2021 and May 25, 2021 (NE-072 to NE-075); Lincoln-Lancaster County DHM for everyone two and older, Aug. 26 - Dec. 23, 2021 (NE-080 to NE-082, NE-106, NE-107); Lincoln Public Schools PreK-6 from Aug. 9, 2021 (NE-109); EO 21-05 (May 24, 2021) barred State agencies from requiring masks (NE-065).

Vaccination mandates

None issued by Nebraska for health-care workers, State employees or the public in 2020-2021; the State's vaccine instruments were allocation and provider directives inside the DHMs (Mar. 16 - Apr. 30, 2021: providers must use the State registration system by Apr. 1; Federal Retail Pharmacy partners limited to 65-plus, health-care and critical-infrastructure workers, then 50-plus) (NE-028) and EO 21-01 (Jan. 7, 2021) suspending the pharmacist-technician supervision ratio to expand vaccinators (NE-063); the DHMs of Jan. 30, 2021 onward exempted fully vaccinated persons from quarantine (NE-093, NE-094).

Standing duties

The statutes, codes and penalty provisions of Nebraska that stood before March 2020 and ran through every claimable quarter. They are the reason nothing an employer did under the orders was voluntary. Read the Nebraska duties →

Nebraska's compulsion ran on four standing tracks that predate COVID-19 and outlasted the Directed Health Measures. First, the communicable-disease statutes: the Department of Health and Human Services holds 'supervision and control of all matters relating to necessary communicable disease control' and, in an emergency in which the health of the people of the State or any locality 'is menaced by or exposed to any contagious, infectious, or epidemic disease,' 'shall adopt, promulgate, and enforce special communicable disease control rules and regulations,' which 'All officers and other persons shall obey and enforce' (Neb. Rev. Stat. section 71-502; Ex. NE-099); the Department has 'supervision over all matters of quarantine and quarantine regulations' (section 81-601; DUT-NE-003); every local public health department 'shall make and enforce regulations to prevent the introduction and spread of contagious, infectious, and malignant diseases' and 'shall enforce and provide penalties for the violation of such rules and regulations' (section 71-501; DUT-NE-001); violation of these sections or of the rules adopted under them is a Class V misdemeanor for each offense and grounds for an injunction by the Attorney General or county attorney (section 71-506; DUT-NE-005); violation of a local board's communicable-disease rule is a Class III misdemeanor with each day a separate offense (section 71-1631.01; DUT-NE-007), and violation of a county resolution is a Class III misdemeanor punishable by up to three months and $500 with each day a separate offense (sections 23-174 and 23-114.05; DUT-NE-011, DUT-NE-012). The Department's 2007 rule, 173 NAC 6, defines a Directed Health Measure as 'any measure, whether prophylactic or remedial, intended and directed to prevent or limit the spread of communicable disease,' authorizes quarantine of 'Buildings and premises, or of defined areas, public and private,' 'work quarantine,' 'Use of PPE... at specified premises,' 'Specific infection control measures including cleaning,' and 'Such other protocols or measures as may be identified as effective against public health threats by the American Public Health Association and the... CDC or other similar public health authority,' makes every order effective immediately and an order to 'comply with the terms of the Order,' and requires law enforcement and local health personnel 'to aid the Department in enforcement of the Order' (DUT-NE-004). Every Directed Health Measure in the library recited that authority, ordered 'all persons' in the covered counties 'to comply,' and warned that 'Failure to comply with this Order will result in legal action for enforcement by civil and/or criminal remedies' (Ex. NE-002, NE-008, NE-013, NE-021, NE-026). Second, the Emergency Management Act: 'Each person within this state shall conduct himself or herself and keep and manage his or her affairs and property in ways that will reasonably assist and will not unreasonably detract from the ability of the state and the public successfully to meet disasters, emergencies, or civil defense emergencies,' an obligation that 'shall include... use or restriction on the use of property' (section 81-829.57; DUT-NE-009); every emergency management organization 'shall execute and enforce such orders, rules, and regulations as may be made by the Governor' (section 81-829.64; DUT-NE-010); and the Governor may 'Control ingress and egress to and from a disaster area, the movement of persons within the area, and the occupancy of premises within the area' (section 81-829.40; Ex. NE-100). The Act contains no general penalty section; Nebraska enforced its pandemic commands through the Directed Health Measures and the communicable-disease penalties, which is why the Governor's executive orders were paired with DHHS orders. Third, the workplace-safety duties: Nebraska is a federal-OSHA State, so every Nebraska employer engaged in a business affecting commerce was bound by 29 U.S.C. 654(a)(1) to furnish 'a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm' (DUT-NE-017); Nebraska's own statutes required that every factory, mill, workshop, mercantile or mechanical establishment 'or other building, where one or more persons are employed' be 'ventilated and kept in a sanitary condition' (section 48-404; DUT-NE-014) on pain of a Class II misdemeanor (section 48-424; DUT-NE-015), directed the Commissioner of Labor to adopt and enforce safety codes so that 'all employments and places of employment' provide 'reasonable and adequate protection to the lives, health and safety of all persons employed therein and frequenting the same' (section 48-412; DUT-NE-006), and, in the text in force in 2020-2021, required 'every public and private employer subject to the Nebraska Workers' Compensation Act' to 'establish a safety committee' that 'shall adopt and maintain an effective written injury prevention program' (section 48-443; DUT-NE-016). OSHA's March 2020 guidance (Ex. FED-088) is recorded as what its text says it is, 'advisory in nature,' and its legal effect in Nebraska came through the general duty clause and, from May 26, 2021, through the liability shield. Fourth, the liability shield: LB 139, approved May 25, 2021 with an emergency clause, bars any civil action for COVID-19 exposure on or after May 26, 2021 'if the act or omission alleged to violate a duty of care was in substantial compliance with any federal public health guidance that was applicable to the person, place, or activity at issue at the time of the alleged exposure,' with 'federal public health guidance' defined as CDC, CMS and OSHA guidance, written or oral (DUT-NE-019, DUT-NE-020); the Introducer's Statement of Intent describes protection for businesses 'provided that such persons follow public health guidance' (DUT-NE-021). The Legislature thereby declared compliance with the federal health guidance the standard of care for the second and third quarters of 2021. The sanitary code bound food establishments independently: a permitholder 'shall comply with the act, the rules and regulations adopted pursuant thereto, and any order of the director,' and the Director may order an establishment 'closed prior to hearing' upon 'an immediate danger to the public health, safety, or welfare' (section 81-2,273; DUT-NE-023), with violations a Class IV misdemeanor (section 81-2,290; DUT-NE-024); maintaining a nuisance 'to the injury of any part of the citizens of this state' is a Class III misdemeanor with mandatory abatement (section 28-1321; DUT-NE-022). The orders' operating conditions were commands: 'Such businesses shall require the use of masks,' 'Such businesses shall require six (6) feet of distance between patrons,' venues 'must submit a plan for reopening' that 'must be approved by the Local Public Health Department,' employers providing congregate housing 'must, at minimum, (1) post signage... (3) perform daily verbal screening and temperature checks' (Ex. NE-013, NE-021); 'Owners of Establishments shall ensure' seating, spacing and employee face protection (Ex. NE-079); any entity maintaining premises open to the public 'shall require' face coverings (Ex. NE-072, NE-079). The verbs that recommended are recorded as recommendations: 'should adhere to any State-issued guidance' and 'reminded to follow' (Ex. NE-021), 'adherence to any applicable State issued guidance is strongly recommended' (Ex. NE-026, the green-phase orders of January 30 to May 24, 2021). No Nebraska Attorney General opinion of 2020 or 2021 addressed Directed Health Measures (the opinion archive was read), and no Nebraska appellate decision of the period on business compliance was located with this session's tools.
