ScopeCounty, municipal, transit-district and local-court instruments of the Salt Lake City metropolitan area from March 10, 2020 through September 30, 2021: Salt Lake County Health Department public health orders issued jointly by Mayor Jennifer Wilson and Executive Director Gary Edwards (and, in 2021, Executive Director Angela Dunn) under Utah Code 26A-1-114 and Salt Lake County Code 2.86.050(E); Salt Lake City Mayor Erin Mendenhall's emergency proclamations and executive orders under Utah Code 53-2a-208, -209 and Salt Lake City Code ch. 22.03; Summit County's declarations, Health Officer orders and joint public health orders (Health Officer Richard Bullough, then Philip Bondurant; County Manager Thomas Fisher; the Summit County Council) under Utah Code 26A-1-114, 17-50-302 and Summit County Code 5-4-6; Utah County Health Department orders (Executive Director Ralph Clegg) and the September 2020 joint order with the Utah County Commission; the Utah Transit Authority's rider rules; and the local court orders listed on the Utah courts' alerts page. The Salt Lake City metropolitan area ran a three-layer regime in which the local layer moved first, went further than the State, and returned in the third quarter of 2021 after the State's general restrictions had ended. Run-up and 2020 Q2. Salt Lake City declared a local emergency on March 10, 2020 (Ex. MET-SLC-020) and on March 12 prohibited every 'private or public mass gathering' of 100 or more within the City (Ex. 021), a prohibition that stayed in force until September 8, 2020 (Ex. 026). Summit County's Manager and Health Officer declared local and public health emergencies on March 12 (Exs. 001, 002); on March 15 Public Health Order 2020-01 closed every restaurant, bar and tavern to the public at 5:00 p.m. (curbside and drive-through only, by memorandum of understanding; third-party delivery prohibited), closed every ski resort, theater, museum, gym, church and entertainment venue, closed hotel pools, gyms, spas and conference rooms, banned gatherings over 100 (20 if anyone over 60 was present), suspended special-event permits and made violations Class B misdemeanors (Ex. 003); Public Health Order 2020-02 of March 23 cut gatherings to 10, imposed mandatory construction-site rules and held salons to 50 percent occupancy with lobbies closed (Ex. 004). Salt Lake County's Mayor proclaimed a state of emergency on March 16, the Health Department's Order 2020-01 (March 16) barred restaurants from admitting patrons except for take-out pickup, and Order 2020-02 (March 19) ordered that 'No gatherings over ten (10) people shall be held' countywide for thirty days, with Class B and Class A misdemeanor penalties and each day a separate offense (Ex. 041). Utah County's Health Officer closed every food-service establishment to the public at 11:00 p.m. March 18 and banned gatherings over ten (Ex. 050), replaced that order March 23 (take-out only by remote order; Ex. 051) and again April 3, when he made compliance with isolation and quarantine notices mandatory for every positive, exposed and household member (Ex. 052). Summit County's Joint Public Health Order 2020-03 (March 25) ordered every resident to stay at home from 12:01 a.m. March 27 to May 1, ordered every non-essential business to 'cease all activities at facilities located within the County except Minimum Basic Operations,' prohibited 'all public and private gatherings of any number of people' and all non-essential travel, and directed visitors to leave by April 1 (Ex. 005). Salt Lake City directed all persons to stay at home on March 27 (Ex. 022) and on March 29 adopted the County's Stay Safe, Stay Home order (Public Health Order 2020-03, Mayor Wilson, March 29, effective March 30; extended to May 1 by Order 2020-04 of April 10) as binding on every City resident and business (Ex. 023). Reopening was by order: Summit County's Joint Orders 2020-05 (Orange, May 1), 2020-06 (Orange, May 16) and 2020-07 (Yellow, May 22) made the State's Phased Guidelines 'mandatory and enforceable under law' for every business (Exs. 009-011); Salt Lake County's Order 2020-06 ordered every resident, business and community organization to 'comply with the Moderate Risk or Orange Guidelines' from May 1 (Ex. 045), followed by Orders 2020-06.1, -07, -08, -09 and -10 tracking each new version of the Guidelines through June 12 (Ex. 082). Summit County's Resolution 2020-07 extended the local emergency to September 1 and barred every special-event permit until then (Ex. 008). On June 26, 2020, with the Governor's approval, Summit County (Joint Order 2020-08, Ex. 012) and Salt Lake County (Order 2020-11, Ex. 082) made face coverings mandatory from June 27. 2020 Q3. Both mask orders were amended and extended (Summit 2020-08 Amended, July 2, Ex. 013; 2020-09, August 26, to January 8, 2021, Ex. 014; Salt Lake County 2020-12, July 2, to August 20; 2020-13, August 19, to January 5, 2021; 2020-14, September 24, masks outdoors where six feet impossible, Ex. 082); Salt Lake City's gathering ban ran to September 8 (Ex. 026); Utah County's Health Officer and County Commission jointly ordered face coverings countywide on September 22, 2020, the day the State placed Provo and Orem in Orange (Ex. 053). 2020 Q4. Summit County's Joint Order 2020-10 (October 22) implemented the Transmission Index and kept the mask order to January 8, 2021 (Ex. 015); Salt Lake County's Order 2020-15 (October 26) did the same (Ex. 082); Utah County terminated its mask order October 19 because the State's Transmission Index order now required masks in the county (Ex. 054). 2021 Q1-Q2. Summit County's Health Officer extended the local public health emergency on January 9, 2021 (recited in Ex. 018); the statewide mask mandate (UDOH orders) covered the metro until April 10, 2021; on April 7-8 Salt Lake City reimposed a citywide mask order (Proclamations 2 and 3 of 2021, Exs. 027-028) that ended with the City's emergency on May 4, 2021 when HB 294's thresholds were met (recital, Ex. 030); Summit County's emergency 'ended in May 2021' under HB 294 (Ex. 018); from May 10 the City required masks in every City facility (Exs. 031, 032). 2021 Q3. Salt Lake City required masks of every employee and visitor in City buildings and vehicles from July 28 (EO 3 of 2021, Ex. 029); the Salt Lake County Health Department's Order 2021-2 (August 11) required K-6 masks countywide and the County Council terminated it on August 12 by a 6-3 vote under the SB 195 regime (Exs. 079, 080, 082); Salt Lake City declared a second local emergency and ordered masks in every K-12 school in the City on August 20, 2021, and the City Council extended the order 6-1 on September 14 (Exs. 030, 034); Summit County declared a Delta-variant public health emergency and issued Order 2021-01 (Order of Constraint) on August 21, effective August 25, requiring masks at any elementary campus reaching a 2 percent 14-day case rate, which the Council declined to terminate (Exs. 016, 018, 081), and its Health Officer ordered the same regime for junior high and middle schools on September 23, 2021 (Ex. 019); the Utah Transit Authority required masks of every rider under the CDC conveyance order all quarter (Ex. 090). Utah County issued no order after October 19, 2020.

End of general restrictions

Instrument For the counties: Salt Lake County Order 2020-06 (Apr. 30, 2020) rescinded 'all prior Public Health Orders related to COVID-19' and replaced the stay-home regime with mandatory Moderate Risk guidelines from May 1, 2020; the county mask orders (Salt Lake County 2020-11 to 2020-15; Summit County 2020-08 to 2020-10) ran to January 5 and January 8, 2021 respectively and were overtaken by the statewide mask mandate (UDOH, Nov. 9, 2020 - Apr. 10, 2021); Salt Lake City's citywide mask order (Procl. 3 of 2021) and its March 10, 2020 local emergency terminated May 4, 2021 under HB 294 (recital in Ex. MET-SLC-030); Summit County's local public health emergency 'ended in May 2021' under HB 294 (Ex. MET-SLC-018).

What remained in force

Salt Lake City's executive orders requiring masks in City facilities (EO 1 of 2021 from May 10, 2021, amended May 14; EO 3 of 2021 from July 28, 2021); the SB 195 order-of-constraint regime under which Salt Lake County issued Order 2021-2 (Aug. 11, 2021), Salt Lake City issued its K-12 mask order (Aug. 20, 2021, extended Sept. 14) and Summit County issued Order 2021-01 (Aug. 21, 2021) and the junior-high order (Sept. 23, 2021); the Utah Transit Authority's mask requirement under the CDC conveyance order; the Utah Supreme Court and Judicial Council pandemic orders (State file UT-050 to UT-053).

The State and the local orders

Utah licensed local orders above the State floor in 2020 and then subjected them to legislative-body termination in 2021. Utah Code 26A-1-106(2) (recited in Summit County Joint Order 2020-03 and Salt Lake County Order 2020-06) forbids local health regulations 'less restrictive than' State Department of Health orders; the Governor's Directive of March 27, 2020 stated that 'local authorities may impose more stringent directives and orders' after consultation and consent (State file UT-004). From May 1, 2020 the Governor's phase orders superseded local orders except on exemption: Summit County applied to the Department of Health on April 28, 2020 and 'the Governor granted the County an exception from the Governor's Executive Order' under Utah Code 53-2C-103 (SB 3004) on April 29 (Ex. MET-SLC-009), again on May 1 and May 14 (Ex. MET-SLC-010), and obtained 'an exemption from the Governor's Executive Order 2020-32, which allows the County to impose a mandatory face covering order' in June 2020 (Ex. MET-SLC-012); Salt Lake County's June 26, 2020 mask order was issued with the Governor's approval and its August 19, 2020 extension under EO 2020-50's notice procedure (Ex. MET-SLC-082; State file UT-021). Salt Lake City's proclamations recite that the County's order superseded the City's stay-home proclamation (Ex. MET-SLC-023). In 2021 the Legislature took control: HB 294 (Mar. 24, 2021) terminated the statewide mask requirement on April 10, 2021 and every remaining COVID order, including local emergencies, when three thresholds were met, which the Department of Health certified on May 4, 2021 (recital in Ex. MET-SLC-030); SB 195 (effective May 5, 2021) defined a face-covering mandate as an 'order of constraint' that may be issued only during a declared local public health emergency, limited such emergencies to 30 days absent county legislative extension, and authorized the county legislative body to 'terminate an Order of Constraint at any time' (Utah Code 26A-1-114(9)(a), recited in Ex. MET-SLC-016); HB 1007 (May 28, 2021) barred school boards from requiring masks. The consequence in Q3 2021: the Salt Lake County Council terminated the Health Department's K-6 order the day after it issued (Aug. 12, 2021, 6-3; Exs. MET-SLC-079, -080); the Summit County Council announced it did 'not currently intend to consider termination' of Order 2021-01 (Ex. MET-SLC-081); and the Salt Lake City Council extended the Mayor's K-12 order 6-1 on September 14, 2021 (Ex. MET-SLC-034).

Fitness and entertainment

Summit County closed ski resorts, theaters, music and dance clubs, golf and country clubs, museums, gyms, exercise studios, spas and every entertainment venue at 5:00 p.m. Mar. 15, 2020 (MET-SLC-003); Salt Lake City closed park playgrounds, fitness equipment, team-sport fields and facility rentals Mar. 27 - Sept. 8, 2020 (MET-SLC-022, -023, -026); Summit County barred special-event permits Mar. 12 - Sept. 1, 2020 (MET-SLC-001, -003, -008); gyms reopened under mandatory protocols May 1-22 (MET-SLC-009 to -011); Summit masks in gym common areas from Aug. 26, 2020 (MET-SLC-014).

Hotels and short-term rentals

Summit County closed every lodging facility's pools, hot tubs, gyms, conference rooms and spas at 5:00 p.m. Mar. 15, 2020, limited hotel food to room service or curbside (MET-SLC-003), directed visitors to leave by Apr. 1 and non-resident owners to stay away (MET-SLC-005), and imposed 'Hospitality, Tourism and Accommodations' protocols from May 1 (MET-SLC-009 to -011); Utah County limited hotel complimentary meals to prepackaged take-out (MET-SLC-052); Salt Lake City restricted airport public areas to ticketed passengers Mar. 27 - Sept. 2020 (MET-SLC-022, -023).

Offices and telework

Summit County ordered every non-essential business to cease on-site activities except Minimum Basic Operations Mar. 27 - May 1, 2020 and employees to work from home (MET-SLC-005), then directed 'Work from home whenever possible' and mandatory daily employee screening with logs from May 1 (MET-SLC-009); Utah County's orders directed employers to encourage remote work (MET-SLC-050); Salt Lake County Order 2020-06 made the Orange rule 'Employees and volunteers of businesses operate remotely, unless not possible' mandatory from May 1 (MET-SLC-045); masks for employees in public-facing spaces June 27, 2020 - Jan. 2021 (MET-SLC-012, -082); Salt Lake City required masks of every City employee and visitor in City facilities May 10 - Sept. 30, 2021 (MET-SLC-029, -031, -032).
