Operative words
Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. [§ 31-367(d):] "Employer" means the state and any political subdivision thereof.
Penalty
§ 31-382: civil penalty up to $10,000 for each wilful or repeated violation, up to $1,000 for each serious violation and for each day of failure to correct; criminal penalties for wilful violations causing death
What it required
Every public employer in Connecticut (the State and its political subdivisions, including every school district and municipality) to furnish a place of employment free from recognized hazards likely to cause death or serious physical harm and to comply with the standards adopted under the chapter, which by § 31-372 include every federal OSHA standard; § 31-369(b) preserves in full the common-law and statutory duties of all employers (including § 31-49) 'with respect to injuries, diseases or death of employees.'
Retrieval noteConnecticut's State plan covers public employers only (P.A. 77-610 'redefined employer to exclude persons engaged in business'); CONN-OSHA's own description is Ex. DUT-CT-014. Private-sector workplaces in Connecticut are under federal OSHA jurisdiction: 29 U.S.C. § 654(a)(1) (Ex. DUT-CT-009), OSHA's COVID-19 guidance (Exs. FED-088, FED-089) and, from June 21, 2021, the Healthcare ETS, 29 C.F.R. § 1910.502 (Ex. ECO-B-012). No amendment after 1977 to the sections relied on.
