Operative words
Cooperation. Persons subject to isolation or quarantine shall obey the health officer's rules and orders and must not go beyond the isolation or quarantine premises. Failure to obey these provisions is a class B misdemeanor.
Penalty
Class B misdemeanor (23-07.6-02(3), (4)(b)): thirty days and $1,500 for an individual, $20,000 for an organization (12.1-32-01(6), 12.1-32-01.1(5); Ex. DUT-ND-006)
What it required
The State Health Officer or any local health officer 'may order any person or group into confinement by a written directive' where the person or group is reasonably believed infected and 'poses a substantial threat to the public health' (23-07.6-02(1)); confinement 'may include confinement to private homes or other private and public premises' (23-07.6-02(2)(a)); the directive must specify 'the premises subject to isolation or quarantine' and the 'decontamination, treatment, or prevention measures that must be followed' (23-07.6-03(1)(b)); unauthorized entry into confinement premises is a class B misdemeanor (23-07.6-02(4)(b)).
Retrieval noteExecutive Orders 2020-14 and 2020-14.1 (Ex. ND-012, ND-024) suspended the chapter's court-petition procedure for the duration of the emergency and authorized the State Health Officer's disease-control orders under 23-01-05(12); the substantive duty to obey and its penalty were recited in every confinement order: 'a person is guilty of a class B misdemeanor if that person fails to cooperate with this order to quarantine. N.D.C.C. 23-07.6-02(3)' (Ex. ND-014, ND-021, ND-022, ND-026, ND-031, ND-060). The LM Power (ND), Inc. order of Apr. 18, 2020 confined an entire Grand Forks workforce after a workplace exposure (Ex. ND-031).
