Operative words
Accordingly, this list is advisory in nature. It is not, nor should it be considered to be, a federal [directive or standard].... Guidance on the Essential Critical Infrastructure Workforce: Ensuring Community [and National Resilience in COVID-19 Response] Version 1.0 (March 19, 2020)
Enforcement
none (advisory); incorporated by reference in dozens of State and local stay-at-home and closure orders (e.g., Texas GA-14, Pennsylvania's life-sustaining list, the Bay Area health officer orders), which gave it the force of those orders
Notes
CISA's own words fix its legal character: advisory in nature. Its operative effect came entirely from the State and local orders that adopted it, which is why 'essential' designations were the premise of the conditions imposed on the businesses so designated, never an exemption from them.
