Operative words

Following a United States District Court injunction in September to enforce a school mask order for indoor settings, the Department has and will continue to work with schools on enforcing its mask requirement, which includes visits to schools and technical assistance.... This Order supersedes Health Order No. 26. It will expire on November 30, 2021, unless superseded, amended, or renewed... Masks will continue to be required in schools due to the absence of a uniform, reliable approach for providing reasonable accommodations to children with disabilities (and as ordered in a federal lawsuit by a class of parents against Governor Lee and the Department).... Due to the decline in the numbers, the Department highly recommends that businesses continue to require masks in indoor, public settings.

Enforcement

Health Department enforcement; 901-222-MASK reporting line for businesses failing to require masks pursuant to this health order

Notes

Post-period instrument saved for its recitals: it confirms that Health Order No. 26 was in force through September 30, 2021, that indoor masking had been required in businesses, and that a federal injunction of September 2021 compelled the school mask order. Masks required in schools, on public transportation conveyances under the CDC order, and in any business that posts a mask-required notice.
