The record in brief

ScopeTennessee metropolitan instruments: Nashville and Davidson County (Metropolitan Government; Metro Public Health Department Chief Medical Director orders; Mayor's executive orders); Memphis and Shelby County (City of Memphis mayoral executive orders and Face Covering ordinance; Shelby County Mayor's executive orders; Shelby County Health Department Health Directives, Health Orders and Face Mask Directives); Knoxville and Knox County (Knox County Health Department Health Officer orders and regulations; Knox County Board of Health regulations); and the three federal district-court injunctions of September 2021 that compelled school masking in Shelby, Knox and Williamson Counties. Statewide instruments are cited by name and date only.

Tennessee ran a county-driven regime. Six counties with locally run health departments (Shelby, Madison, Davidson, Hamilton, Knox and Sullivan) held independent authority under Tenn. Code Ann. sections 68-2-601, 68-2-603 and 68-2-609, and the Governor's Executive Order No. 30 (April 28, 2020) section 1(c) expressly preserved their power to issue orders more or less stringent than the statewide reopening. Each of the three metropolitan counties in this scope used that power with force of law, and each regime ran on its own calendar. 2020Q2. On the first day of the quarter every business in the metro area sat under a stay-home closure order: Nashville's Amended and Restated Order 3 (issued April 1, 2020; the original Order 3 of March 22, 2020 took effect 12:01 a.m. March 23, 2020) commanded that all businesses not performing essential services shall close their business facilities and prohibited gatherings of more than ten; Knox County's Health Officer order of March 23, 2020 (effective 12:01 a.m. EDT March 24, 2020) used the identical closure clause; Memphis Executive Order No. 03-2020 (March 23, 2020, effective 6:00 p.m. March 24, 2020) required all individuals to stay at their place of residence and closed businesses outside its Essential Activities list, and Shelby County Mayor Harris's executive order of March 24, 2020 did the same for the unincorporated county. Nashville extended its order to May 1 and then to May 10, 2020 and reopened in Phase One under Order 5 (effective May 11, 2020: gatherings of more than ten prohibited; hospitality, educational, sports and entertainment venues remained closed) and Phase Two under Order 6 (effective May 25, 2020: gatherings of more than 25 prohibited). Knox County reopened at 8:00 a.m. May 1, 2020 under a Health Officer order adopting Executive Orders 30 and 31 and the Knox County phased strategy, amended for Phase Two on May 22, 2020. Memphis reopened in Back to Business Phase 1 on May 4, 2020 (Executive Order No. 12-2020 and its May 5 amendment, Executive Order No. 13-2020, which subordinated the City's order to the Shelby County Health Directives) and Phase 2 at midnight May 19, 2020 (Executive Order No. 16-2020). Shelby County Health Directive No. 7 (June 22, 2020) kept every business not listed closed and capped retail, gyms and civic facilities at 50 percent of building occupancy. Nashville's Order 8 (June 28, 2020) made face coverings mandatory for members of the public at all times outside the listed exemptions, and Mayor Cooper's Executive Order No. 7 (May 18, 2020) required them in every Metro building. 2020Q3. The summer surge produced the most aggressive metropolitan orders in Tennessee. Nashville's Order 9 (July 2, 2020) paused Phase Three and returned the county to a hybrid Phase Two; its Amendment 3 (signed July 30, 2020) and Order 10 (August 7, 2020) closed every Limited Service Restaurant in Downtown and Midtown to the public through 11:59 p.m. August 16, 2020 and banned open containers in the Central Improvement District; Order 11 (August 15, 2020) governed the rest of the quarter with capacity, party-size and hours conditions. Knox County's Board of Health adopted Regulation 2020-1 (July 1, 2020), which required a face covering of every person twelve or older within six feet of a non-household member in any indoor public place; Regulation 2020-3 (July 29, 2020) closed bars; Regulation 2020-4 (August 5, 2020) reopened them with a 10:00 p.m. close; Regulations 2020-5 and 2020-6 (September 16, 2020) imposed an 11:00 p.m. alcohol curfew and a 25-person gathering ceiling. Shelby County's Face Mask Health Order and Directive (effective 6:00 p.m. July 3, 2020) required masks countywide and required every business to enforce the requirement; Health Directives Nos. 8 and 9 (July 8 and July 24, 2020) closed restaurants at 10:00 p.m., banned bar seating and standing, tied alcohol to seated food service and capped occupancy at 50 percent. Memphis's Face Covering/Mask Ordinance (passed June 16, 2020) added a municipal mandate. 2020Q4. Nashville moved to Phase Three under Order 12 (September 30, 2020) and then tightened it four times before year end (the Third Amended and Restated Order 12 of November 25, 2020 reduced crowd sizes to eight persons and imposed late-night closures that the Sixth Amended and Restated Order 12 of January 30, 2021 carried forward: service ended at 11:00 p.m. and premises closed to the public from midnight to 5:00 a.m.). Knox County's Regulation 2020-7 (November 25, 2020) capped restaurants at 50 percent and eight per table and closed them from 10:00 p.m. to 5:00 a.m.; Regulation 2020-8 (December 4, 2020) capped gatherings at ten persons. Shelby County's Health Directive No. 16 (December 21, 2020, effective 12:01 a.m. December 26, 2020) was a second Safer at Home order: all businesses except those listed were required to close their physical locations to the public, indoor dining fell to 25 percent with a 10:00 p.m. cutoff, retail and gyms to 50 percent, and Face Mask Directive No. 4 (same date) restated the countywide mask mandate. 2021Q1. Nashville's Sixth and Seventh Amended and Restated Orders 12 (January 30 and March 1, 2021) and Order 13 (March 24, 2021, effective March 26, 2021: crowd sizes above ten indoors or 25 outdoors prohibited; entertainment venues at 25 to 33 percent of ticketed capacity; premises closed 2:00 a.m. to 5:00 a.m.) and the Eleventh Amended and Restated Order 10 for Downtown and Midtown governed the whole quarter, with Order 8 masks throughout. Knox County's Regulations 2021-1, 2021-2 and 2021-3 kept a restaurant curfew (11:00 p.m., then midnight, then 1:00 a.m.) through April 22, 2021, and Regulation 2020-8 held gatherings to ten through March 18, 2021. Shelby County's Health Directive No. 18 (February 17, 2021, effective February 20, 2021) ended all food and beverage service at midnight, limited bar seating to fixed pairs six feet apart, capped food service at two hours, prohibited indoor dancing and incorporated Face Mask Directive No. 4. 2021Q2. Nashville's Amended and Restated Order 8 (April 9, 2021) restated the mask mandate; Order 14 (April 16, 2021) ran a modified Phase Four; Order 15 (issued May 13, effective 5:00 a.m. May 14, 2021) rescinded Order 14 and the Twelfth Amended and Restated Order 10, and Order 16 (effective noon May 14, 2021) rescinded the mask order. Knox County's restaurant regulation expired April 22, 2021, the Board of Health was dissolved April 13, 2021, and the Health Department's own Face Covering Regulation 2021-1 (adopted April 12, 2021) ran by its terms until Executive Order 77 expired on April 28, 2021. Shelby County's directives continued. 2021Q3. Nashville and Knox County issued no general business orders in force July 1 through September 30, 2021. Shelby County did: in August 2021 the Health Department ordered universal indoor masking in every K-12 school, pre-kindergarten and daycare (recited in G.S. v. Lee), reimposed indoor masking countywide (Health Order No. 25), and continued it under Health Order No. 26 until Health Order No. 27 (October 27, 2021) converted the business requirement to a recommendation while keeping the school requirement. Three federal courts then made school masking compulsory by injunction: G.S. v. Lee (W.D. Tenn.; TRO September 3, 2021; preliminary injunction September 17, 2021) for Shelby County; S.B. v. Lee (E.D. Tenn.; preliminary injunction September 24, 2021, amended October 12, 2021) ordering the Knox County Board of Education to enforce a mask mandate with immediate effect; and R.K. v. Lee (M.D. Tenn.; TRO September 24, 2021; preliminary injunction October 22, 2021) for Williamson County and the Franklin Special School District in the Nashville metropolitan area. Memphis extended its limited local state of emergency every seven days through the quarter (Executive Orders Nos. 25-2021 and 26-2021 exhibited).

Instrument Nashville and Davidson County: Order 15 from the Interim Chief Medical Director (issued May 13, 2021; effective 5:00 a.m. CDT May 14, 2021), rescinding Order 14 (April 16, 2021, as amended May 7, 2021) and the Twelfth Amended and Restated Order 10 (April 16, 2021), and Order 16 (effective noon CDT May 14, 2021), rescinding Amended and Restated Order 8 (April 9, 2021). Knox County: Board of Health Regulation 2021-3 expired by its terms at the end of April 22, 2021; the Board of Health was dissolved April 13, 2021; Knox County Health Department Regulation 2021-1 (face coverings) ran until the expiration of Executive Order 77 on April 28, 2021. What remained in force

After May 14, 2021 in Nashville: the Board of Health's Declaration of Public Health Emergency of March 15, 2020 and the Mayor's weekly civil-emergency extensions (EMER predicate); no MPHD business order. After April 28, 2021 in Knox County: guidance only (KCHD Resolution 2021-A, April 23, 2021). In Shelby County throughout: the Health Department's directive chain (Nos. 19-24, spring and summer 2021), Face Mask Directive successors, Health Orders Nos. 25 and 26 (August-October 2021), the City of Memphis limited local state of emergency extended weekly (Executive Orders Nos. 25-2021, 26-2021 and successors), and, from September 3 and 17, 2021, the federal injunction in G.S. v. Lee compelling enforcement of the school mask order. Across the metro area: Governor's Executive Order No. 83 (August 6, 2021, state of emergency continued) and Executive Order No. 84 (August 16, 2021, parental opt-out from school mask requirements) by name; the CDC conveyance mask order (86 Fed. Reg. 8025) on WeGo, MATA and KAT transit and at BNA and MEM airports.

The State and the local orders

Tennessee did not preempt the six locally run county health departments during the period. Executive Order No. 30 (April 28, 2020) section 1(c) preserved their authority to issue orders more or less stringent than the statewide reopening; Executive Orders Nos. 38 (May 22, 2020), 50 (June 29, 2020), 63 (September 29, 2020), 67 (October 30, 2020), 70 (December 20, 2020), 73 (December 22, 2020) and 77 (February 26, 2021) repeated the reservation, and Knox County Health Department Regulation 2021-1 (April 12, 2021) recites Executive Order No. 38's delegation and the Attorney General's Opinion No. 20-07 (April 27, 2020) confirming that local health officers confronting an epidemic have the power and the obligation to establish appropriate control measures. Executive Order No. 80 (April 27, 2021) ended the mask authority the Governor had delegated to the other 89 county mayors; the six health-department counties (Davidson, Shelby, Knox among them) kept theirs, and Shelby County used it again in August 2021. Executive Order No. 84 (August 16, 2021) did not preempt local school mask requirements; it created a parental opt-out, and three federal district courts enjoined its enforcement in Shelby County (G.S. v. Lee, September 17, 2021), Knox County (S.B. v. Lee, September 24, 2021) and Williamson County (R.K. v. Lee, September 24, 2021). The General Assembly's Public Chapter 6 of the Third Extraordinary Session (signed November 12, 2021), which barred local mask mandates and stripped the six county health departments of independent COVID-19 authority, took effect after the period and confirms that until then those departments held that authority. Metro Nashville and Knox County chose to end their own orders (May 14, 2021 and April 22-28, 2021); no State instrument ended them.
